ORDINANCE NO. 52-73 BY: Messrs. Usher, Werner, Brockman, Gmber, <br /> Magnotto, McBride, Sinagra <br /> <br /> AN EMERGENCY ORDINANCE to amend existing paragraph (b) of Section 135.07 <br />of the Administrative Code of the Codified Ordinances of the City of Lakewood <br />relating to the fee to be charged for conducting polygraph tests by employees in <br />the Division of Police. <br /> <br /> WHEREAS, the cost of operation, repair and replacement of equipment required <br />to conduct polygraph examinations has risen substantially during the past eleven years <br />and , <br /> <br /> WHEREAS, the current schedule of fees chargeable for the conducting of <br />polygraph examinations, which schedule was enacted in 1962, is wholly inadequate to <br />meet the cost of operation and repair of such equipment and particularly is wholly <br />inadequate to meet the cost of replacement of such equipment, and <br /> <br /> WHEREAS, the Division of Police is authorized to and does assist other <br />municipalities in the investigation of crime and in the determination of qualifications <br />of employment by the use of polygraph examinations, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for the <br />immediate preservation of the public health and safety and for the usual daily <br />operation of a municipal department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1o That existing paragraph (b) of Section 135.07 of the Administrative <br />Code of the Codified Ordinances of the City of Lakewood, which presently reads as <br />follows: <br /> <br />"135.07 POLYGRAPH TESTS; FEES. <br /> <br />In order to defray the cost of' the polygraph examination, the <br />Chief of the Division of Police is authorized and directed to <br />charge a fee of twenty-five dollars ($25.00) for each polygraph <br />examination given for the investigation of crime, and a fee of <br />fifteen dollars ($15.00) for each polygraph examination given <br />t° determine qualifications for employment in police departments. <br />Such fees collected shall be paid by the Chief of the Division of <br />Police to the Director of Finance, who shall credit them to the <br />General Fund of the City." <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />"135.07 POLYGRAPH TESTS; FEES. <br /> <br />(b) <br /> <br />In order to defray the cost of the polygraph examination, the <br />Chief of the Division of Police is authorized and directed to <br />charge a fee of forty dollars ($40.00) for each polygraph <br />examination given for the investigation of crime, and a fee of <br />twenty-five dollars ($25.00) for each polygraph examination given <br />to determine qualifications for employment in police departments. <br />Such fees collected shall be paid by the Chief of the Division of <br />Police to the Director of Finance, who shall credit them to the <br />General Fund of the City." <br /> <br /> <br />
