'ORDINANCE NO. 76-73 .... BY:' MeSsrs. Brockman, Graber, Magnotto, McBride, Sinagra, Usher, Werner AN EMERGENCY ORDINANCE authorizing and directing the Mayor, for and on behalf of the City of Lakewood, to enter into a purchase agreement with Cook United, Inc. to purchase the certain real estate situated at the Northwest corner of Lakewood Height's Boulevard and Warren Road in connection with the construction of a new in-door artificial ice rink at said location. WHEREAS, the City is desirous of purchasing the property at the Northwest corner of Warren Road and Lakewood Heights Boulevard for the construction of a new artificial ice rink at said location, in accordance with plans and specifications approved by this Council on November 19 1973, and ' WHEREAS, Cook United, Inc., the owner of said property, is willing to sell same to the City of Lakewood for the amount equal to its appraised value, to wit, $415,000.00, less the amount of compensation to be received by Cook United, Inc. from the State of Ohio for the sale of a small portion of said property to the State of Ohio for highway construction purposes, and WHEREAS, the State of Ohio has advised that unless all negotiations involving said parcel are not completed within 10 days, the State will be required to file appropriation proceedings so as to protect its interests in connection with the Interstate 90 project, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department and for the further reason that a purchase agreement should be entered into forthwith so as to eliminate the necessity of the State of Ohio filing an appropriation action which would only serve to increase costs to all parties concerned and result in unnecessary delay of the construction of Interstate 90; now, therefore, BE IT ORDAINED BY THE COUNCIL OF T~E CITY OF LAKEWOOD, STATE OF OHIO Section 1. That the Mayor be,.and he is hereby authorized and directed, for and on behalf of the City of Lakewood to enter into a purchase agreement with Cook United, Inc. to purchase the certain real estate situated at the Northwest Corner of Lakewood Heights Boulevard and Warren Road for the amount of $415,000.00, less the amount of compensation, received by Cook United, Inc. from the State of Ohio, to wit, $24,220.00, such purchase agreement to be substantially as set forth in Exhibit "A" attached hereto and made a part hereof. Section 2. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of mi1 members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor
