ORDINANCE NO. 6- 74 <br /> <br />BY:Messrs. Magnotto, McBride, Sinagra,' <br /> Usher, Brockman, Chinnock, Graber <br /> <br /> AN EMERGENCY ORDINANCE to enact new SeCtion 101o99 of the <br />Administrative Code of the Codified Ordinances of the City of Lakewood. <br /> <br /> WHEREAS, included in amended Hou. se Bill 511, effective January <br />1, 1974, was the classification of misdemeanors, and <br /> WHEREAS, the Codified Ordinances of the City of Lakewood should <br />be adopted and enacted to conform to State law at the earliest possible <br />tim~e, and <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and <br />for the usual daily operation of a municipal department; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO <br /> Section 1. That Section 101.99 of the Administrative Code of the <br /> Codified Ordinances of the City of Lakewood be and the same is hereby enaCted <br /> to read as follows: <br /> <br />SECTION 101.99 GENERAL PENALTY .... <br /> <br />Whenever, in the Codified Ordinances or in any Ordinance of the <br />Municipality, any act is prohibited or is made or declared to be <br />unlawful, or an offense, or a misdemeanor, or whenever the doing <br />of any act is required or the failure to do any act is declared <br />to be unlawful, where no specific penalty is otherwise provided, <br />the violation of any such provision shall constitute a minor <br />misdemeanor and shall be punished by a fine not exceeding One <br />Hundred Dollars ($100.00). A separate offense shall be deemed <br />committed on each day during or on which a continuing violation <br /> <br />occurs. <br /> <br /> Section 2. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble, and-provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force'immediately upon its adoption and approval by the Mayor, <br />and exlstln Section 101.99 of the Admini~'~ve Code of ~the%Codified Ordinances <br /> · . g · ~ <br />of the City of Lakewood shall be and the/same i~ hereby~p~e~ed. <br /> <br />Mayor <br /> <br /> <br />
