ORDINANCE NO. 44-74 BY: Messrs. Magnotto, McBride, Sinagra, <br /> Usher, Bro ckman <br /> AN EMERGENCY ORDINANCE to enact a new paragraph to supplement <br />Section 1603.12 of the Regional Building Code of the City of Lakewood and <br />enacting new Paragraph (c) of Section 1505.05 of the Regional Dwelling House. <br />Code to require the registration of contractors and subcontract'ors with the <br />Bui!din~ Department of the City of L~kewood ori..or to tb~ ~u~nc~ cf z b~ildin~ <br /> <br /> WHEREAS, a substantial number of contractors and subcontractors are <br />performing work in the City of Lakewood and the City Income Tax-should be <br />withheld from the wages of their employees, and <br /> <br /> WHEREAS, there is currently no procedure to d~termine whether or not <br />such monies are being withheld from the wages of such employees, and <br /> <br /> WHEREAS, it is in the best interest of the City that continued efforts <br />be made to enforce and improve income tax collection, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the preservation of the public safety and welfare and the usual daily operation <br />of a municipal department and for the further reason that it is necessary to <br />immediately provide regulations for the Building Department and the Administrator <br />of the City Income Tax in the control and regulation of building within the City; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1603.12 of the Regional Building Code of the <br />City of Lakewood be and the same is hereby supplemented hy adding a new <br />paragraph so that same shall read as follows: <br /> <br />The Building Official shall examine applications for permits, within <br />a reasonable time after filing. If, after examination, he finds no <br />objections to the same and it appears that the proposed work will be <br />in compliance with the laws and ordinances applicable thereto and the <br />proposed construction or work will be safe, he shall approve such <br />application and issue a permit for the proposed work as soon as <br />practicable. If his examination reveals otherwise, he shall reject <br />such application, note bis findings in a written report to be attached <br />to the application and thereupon deliver a copy to the applicant. <br /> <br />No permit shall be issued until the applicant has registered on a form <br />prescribed and furnished by the Administrator of the ,City. Income Ta~, <br />the name of the general contracnor, suoconur~ctors and all other persons <br />involved with the actoal construction~ the place of business of each, <br />and the person or persons to whom correspondence shall be directed ~or <br />each such contractor~ subcontractor or other persons involved. Upon <br />issuance of the permit the Building Official shall' transmit said form <br />to the City Income Tax Administrator. <br /> <br /> Section 2. That Section 1505.05 of the Regional Dwelling House Code <br />of the City of Lakewood be and the same is hereby supplemented by enacting <br />new Paragraph (c) to read as follows: <br /> <br />(c) No permit shall be issued until the applicant has registered on a <br />form prescribed and furnished by the Administrator of the City Income <br />Tax, the name of the general contractor, subcontractors and all other <br />persons involved with the actual construction, the place of business of <br />each, and the person or persons to whom correspondence shall be directed <br />for each such contractor, subcontractor or other person involved. Upon <br />issuance of the permit, the Building Official shall transmit said form <br />to the City Income Tax Administrator. <br /> <br /> <br />
