ORDINANCE NO. 48-74 BY: Messrs. Usher, Brockman, Chinnock, <br /> Graber, Magnotto, Mc~Bride, Sinagra <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an <br />Agreement to accept a permanent water line easement in and to the property <br />located at 12550 Lake Avenue, Lakewood, Ohio from Transcon Builders, Inc. <br />and to abandon and release the existing water line easement in and to said <br />property. <br /> <br /> WUEREAS, Transcon Builders, Inc. is the owner of the property <br />located at 12550 ~Lake Avenue, Lakewood, Ohio at which location The Meridian <br />is currently under, construction, and <br /> WHEREAS, duc to the construction of an underground parking garage <br /> it was necessary to abandon the existing water line'and to re-locate same <br /> around said underground parking garage, and <br /> WHEREAS, the City of Lakewood desires to maintain the new underground <br />water main for the benefit of the residents of the City of Lakewood~ and no longer <br />has need for the existing water line easement, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br /> the immediate preservation of the public health and welfare and for the usual <br /> daily operation of a municipal department; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That for and in considerattou of sum of One Dollar ($1.00) <br /> paid by the City of Lakewood, Ohio the Mayor be and he is hereby authorized and <br /> directed to enter into and accept a certain water line easement in and to the <br /> property located at 12550 Lake Avenue, Lakewood, Ob~ o from Transcon Builders, <br /> Inc. and to abandon and release the existing water line easement in and to said <br /> property, a copy of which acceptance, abandonment and release is attached hereto <br /> and made a part hereof. <br /> Section 2. That this Ordinance is hereby declared to be an emergency <br /> provided it receives <br /> measure for the reasons stated in the preamble hereof and <br /> elected to Council it shall <br /> the affirmative vote of two-thirds of all member!
