ORDINANCE NO. 58-74 <br /> <br />BY: Messrs. Brockman, Graber, Piagnotto, <br /> Sinagra, Usher <br /> <br /> AN EMERGENCY ORDINANCE to provide for the submission to the electorate <br />the question of the removal from office of Thomas O. McBride, Councilman of Ward <br />1 of the City of Lakewo6d. <br /> <br /> WHEREAS, pursuant to Article XII, Section 6 of the Amended Charter of <br />the City of Lakewood, the Clerk of this Council has submitted to Council a recall <br />petition demanding that the question of the removal of Thomas O. McBride, Councilm <br />of Ward 1, be submitted to the electors, together with her certificate that said <br />recall petition has been signed by qualified electors equal in number to at least <br />tWenty-five percent (25%) of the total valid ballots cast at the last preceding <br />general municipal election for the office of Councilman of Ward 1 of the City of <br />Lakewood, and <br /> <br /> WHEREAS, pursuant to Article XII, Section 6 of the Amended Charter of <br />the City of Lakewood, Council shall, in the event the official whose removal is <br />sought does not resign within five(5) days after said official has received <br />notice of the sufficiency, of the recall petition, order and fix a day for holding <br />a recall election, and <br /> <br /> WHEREAS, Thomas O. McBride has not resigned from his office of Councilma <br />of Ward 1 within five (5) days of receiving such notice as aforesaid, and <br /> <br /> WHEREAS, such election shall be held not less than thirty (30)'nor more <br />than forty (40) days after the day the petition has been presented to the Clerk, <br />to wit, June 24, 1974; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the question of the removal from office of Thomas O. <br />McBride as Councilman of Ward 1 of the City of Lakewood be submitted to a vote <br />of the qualified electors of Ward I of the City of Lakewood at a special election <br />to be held on Tuesday, the 30th day of July, 1974 at the regular places of voting <br />in the City, between the hours of 6:30 a.m. and 6:30 p.m. <br /> <br /> Section 2. That the ballots for said recall election shall be submitte~ <br />by the question: "Shall Thomas O. McBride be removed from the office of Councilm~ <br />of Ward 1 of the City of Lakewood by recall?" Immediately following such questio~ <br />there shall be printed on the ballots the two propositions in the order set forth <br />"For the recall of Thomas O. McBride" and "Against the recall of Thomas O. McBrid4 <br />Immediately to the left of the propositions there shall be placed a square in whi, <br />the electors, by marking a cross (X) mark, may vote for either of such propositiol <br /> <br /> Section 3o That the Clerk of Council be and she is hereby directed to <br />certify a copy of this Ordinance~to the Board of Elections of Cuyahoga County, Oh <br /> <br /> Section 4. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives th <br />affirmative vote of two-thirds of all members~d to Counc~,/~t shall take <br />effect and be in force immediately upon its a~%tio~ and~a~r~v~/by the Mayor. <br /> <br />Approved~~~.~ ~ /fT~ <br /> <br />Mayor <br /> <br /> <br />
