ORDINANCE NO. 15-75 BY: <br /> <br /> AN EMERGENCY ORDINANCE to amend Paragraph (a) of Section 505.02 of <br />the General Offenses Code of the Codified Ordinances of the City of Lakewood <br />relating to the impounding of dogs and charges to be paid in connection therewith. <br /> <br /> WHEREAS, costs and charges incurred by the City of Lakewood for the <br />impounding of animals have recently been increased and, pursuant to law' owners <br />are required to pay said impoundment costs and charges upon reclaiming their <br />pets, and <br /> <br /> WHEREAS, the aforementioned increase in costs and charges should be <br />assessed against the owners at the earliest possible time, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Paragraph (a) of Section 505.02 of the General <br />Offenses Code of the Codified Ordinances of the City of Lakewood now reading <br />as follows: <br /> <br />505.02 IMPOUNDING AND DISPOSITION; RECORDS <br /> <br />(a) <br /> <br />A police officer or animal warden stall i,,p~und every animal or clog <br />found in violation of Section 505.01. ~ t tl~e impounded clog is not <br />wearing a valid registration tag, the dog sl~a].l forthwith be turned <br />over to an officer charged by ]_aw with th~, c,stody and disposa! of <br />such dogs. If the dog.is wearing a w~lid registration tag or tile <br />identity of the owner or harborer is othcrwLse established, notice <br />shall be given .within two days to such ownc~; or l~orborer that the <br />dog has been impounded. Notice ,lay be by telephone or by ordinary <br />mail. to the last known address of s.ch owner or harborer. Th~ dog <br />sh~ll not be released except upon the payment of the following <br />charges; for impounding any dog, three.dollars ($3.00); for giving <br />notice, three dollars ($3.00); for l<cepJ, ng ~'.my dog, three dollars <br />($3.00) per day. Any dog not re~]ce~',d w~thi, n three (3) da'ys after <br />not,ce is given to the owner or harbot~er as provided herein, or <br />within three (3) days of the time it i,~ seized or impounded, if thc <br />owner or harborer cannot be found, may be sold or otherwise disposed <br />of as provided by R.C. 955.16. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />505.02 IMPOUNDING AND DISPOSITION; RECORDS <br /> <br />(a) iA police officer or animal warden shall inbound every animal or dog <br /> found in violation of Section 505.01. If the impounded dog is not <br /> wearing a valid registration ~ag, the dog shall f~orthwith be turned <br /> over to an officer charged by law with the custody and disposal of <br /> such dogs. If the dog is'wearing a valid registration tag or the <br /> identity of the owner or harborer is otherwise established, notice <br /> shall be given within two days to s~ch owner or harborer that the <br /> dog has been impounded. Notice may be by telephone or by ordinary <br /> mail to the last known address of such.owner or harborer. The dog <br /> shall not be released except upon the payment of the following <br /> charges: for impounding any dog, three dollars ($3.00); for giving <br /> notice, three dollars ($3.00); for keeping any dog, four dollars <br /> ($4.00) per daY. Any dog not redeemed within three (3) days after <br /> notice is given to the owner or harborer as provided herein, or <br /> within three (3) days of the time it is seized or impounded, if the <br /> owner or harborer cannot be found, may be sold or otherwise disposed <br /> of as provided by ~.C. 955.16. <br /> <br /> <br />
