ORDINANCE NO. 25-75 BY: Messrs. Graber, Magnotto, McBride, Sinagra, Usher, 'Brockman, Chinnock AN EMERGENCY OI~INANCE authorizing and directing the Mayor, on behalf of the City of Lakewood, to enter into an agreement with Lakewood Center North Building Associates permitting the City to mount a radio antenna on the roof of the Lakewood Center North Building. WHERI~S, the City of Lakewood, Division of Police, has contracted with The General Electric Company for improvements in its radio communications system and the company has recommended mounting the system antenna on tile highest, most centrally located building available in the community for maximum efficiency, and WHERF~S, Lakewood Center North Building Associates, tile owner of tt~e Lakewood Center North Building, has expressed its willingness to permit a radio antenna to be erected on the roof of its building and at only a very nominal cost to the City, and WHEREAS, it is deemed to be in the best interest of the City to enter into a license agreement with the Lakewood Center North Building Associates, and WHEREAS, this Ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department and for the further reason that said installation should be made at the earliest possible time; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to enter into an agreement with the Lakewood Center North Building Associates, an Ohio Limited Partnership, permitting the installation of a radio antenna on the roof of the Lakewood Center North Building, said agreement to read substan- tially as follows: MEMORANDUM OF AGREEMENT This agreement made and entered into at Lak~ood, Ohio this day of , 1975, by and between LAK~OOD CENTER NORTH BUILDING ASSOCIATES, an Ohio Limited Partnership, and the CITY OF LAKEWOOD: W I T N E S S ET H: 1. Lakewood Center North Building Associates operates a 15-story office building in Lakewood, Ohio and the City of Lakewood desires to construct a radio antenna on the roof of said building for the use of the Police Department of the City. 2. Lakewood Center North Building Associates hereby grants the City of Lakewood the right to enter into its premises, construct, repair, maintain and remove a suitable radio antenna for use by the City's Police Department, together with tile necessary electrical connections for said antenna. 3. This license shall be in effect for a period of one year and shall automatically be renewed for successive periods of one year unless either party gives written notice to the other at least ninety days prior to tile expiration of the original or any renewal term that said license is not to be renewed. 4. The City of Lakewood agrees that it will pay all expenses incurred in the installation, maintenance and removal of said antenna and shall be responsible for any loss or damage caused thereby. The City of Lakewood further agrees that said antenna shall be properly installed in accordance with good engineering practices and with adequate lightning protection so as not to affect the property insurance coverage presently on tile building.
