ORDINANCE NO. 29-75 BY: <br /> <br /> AN EMERGENCY ORDINANCE approving a collective bargaining Agreement <br />with District Council 78 and Local 1043 of the American Federation of State, <br />County and Municipal Employees, AFL-CIO, establishing conditions of employment, <br />working conditions and various employee benefits for certain employees of the <br />Department of Public Works of the City of Lakewood and authorizing the Mayor <br />to sign said Agreement on behalf of' the City. <br /> <br /> WHEREAS, discussions and negotiations have been conducted on behalf <br />of the City with representatives of District Council 78 and Local 1043 of the American <br />Federation of State, County and Municipal Employees, AFL-CIO, with respect to <br />conditions of employment, working conditions and various employee benefits for <br />certain employees of the Department of Public Works of the City of Lakewood, and <br /> <br /> WHEREAS, agreement has been reached in the course of said discussions <br />and negotiations with respect to the conditions of employment, working conditions~ <br />and various employee benefits of the employees aforementioned, and <br /> <br /> W~REAS, this Council determines that it is in the best interest of the <br />City to approve said collective bargaining Agreement and authorize.the Mayor to <br />sign same on behalf of the City, and <br /> <br /> WHEREAS, this Ordnance constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety and welfare and for the <br />usual daily operation of a municipal department, and for the further reason that <br />it is immediately necessary to approve said Agreement at the earliest possible <br />time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF Tl~ CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> .Section 1. That the collective bargaining Agreement with District <br />Council 78 and Local 1043 of the American Federation of State, County And <br />Municipal Employees, AFL-CIO, a copy of which is attached hereto and made a <br />part hereof as though written fully herein, is hereby adopted, ratified and <br />approved and the Mayor is hereby authorized and directed for and on behalf of <br />the City of Lakewood to affix his signature thereto. <br /> <br /> Section 2. That all other ordinances or resolutions, or parts of <br />ordinances or resolutions which are inconsistent with the provisions of this <br />ordinance and the collective bargaining Agreement made a part hereof, are hereby <br />repealed as of the effective date of this ordinance to the extent that they pertain <br />to employees in the bargaining unit covered by the collective bargaining Agreement <br />and are inconsistent with this ordinance, including the collective bargaining <br />Agreement attached hereto and made a part hereof. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members~cted to CounCil, it shall <br />take effect and be in force immediately upon i~adop~ion~a~/~p~oval <br /> by <br /> the <br />Mayor.
