ORDINANCE NO. 33-75 BY: Messrs. Chinnock, Magnotto,' McBride, Sinagra, Brockman AN EMERGENCY ORDINANCE to amend Section 149.17 of the Administrative Code of the Codified Ordinances of the City of Lakewood relating to residence requirements. WHEREAS, this Ordinance constitutes an emergency measure providing for the usual daily operation of a ~unicipal department; ndw, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 149.17 of the Administrative Code of the Codified Ordinances of the City of Lakewood now reading as follows: 149.17 RESIDENCE REQUIREMENTS Except as the Charter may otherwise specifically provide, no person who has been in the employ of ~be City for a period of at least one year shall be required by or pursuant to any order, rule or other action adopted or taken by any official, board or commission of the City, to reside within the territorial limits of the Ci'ty of Lakewood as a condition to: (a) Continuing in such employment; (b) Becoming or being an applicant for admission to any promotional examination; or (c) Being listed on any civil service lists for promotion to higher ~ank to which list such person would otherwise be eligible No person in the employ of the City shall reside outside of that portion of Cuyahoga County which is located westerly of the Cuyahoga River, unless, with respect to the members of the Division of Police the Rules and Regulations of said Division shall provide otherwise. be and the same is hereby amended to read as follows: 149.17 RESIDENCE REQUIREMENTS Except as the Charter may otherwise specifically provide, no person who has been in the employ of the City for a period of at least one year shall be required by or pursuant to any order, rule or other action adopted or taken by any official, board or commission of the City, to reside within the territorial limits of the City of Lakewood as a condition to: (a) Continuing_~n such employment; (b) Becoming or being an applicant for admission to any promotional examination; or (c) Being listed on any civil service lists for promotion to higher rank to which list such person would otherwise be eligible. No person in the employ of the City shall reside outside of that portion of Cuyahoga County which is located westerly of the Cuyahoga River unless, with respect to the members of the Division of Police and the Division of Fire, the Rules and Regulations of said Divisions shall provide otherwise.
