ORDINANCE NO. 39-75 <br /> <br />BY: Messrs. Brockman, Chinnock, Graber, <br /> Magnotto, McBride, Sinag~a, Usher <br /> <br /> AN ORDINANCE to amend Sections 1103.02 and l103.0J of the Zoning Code <br />of the Codified Ordinances of the City of 'Lakewood by changing and revising the <br />Zoning Map and the Building Line Map with resBect to certain properties, all as <br />hereinafter set forth and described. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE'OF OHIO: <br /> <br /> Section 1. That Section 1103.02 of the Zoning Code of the Codified <br />Ordinances of the City of Lakewood be and the same is hereby amended by changing <br />and revising the Zoning Map to the extent that property now having an R-2 Use <br />Classification and being a part of the property described as follows: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and State <br />of Ohio, and known as being part of Original Rockport Township <br />Section No. 23, being bounded and described as follows: <br /> <br />Beginning at a monument at the centerline of Detroit Avenue, <br />66 feet wide, with its intersection with the centerline of <br />Rockway Avenue, 40 feet wide; Thence Soutb 0° 04' 40" East <br />along the centerline of said Rockway Avenue a distance of <br />34.33 feet to a point; Thence South 73° 55' 20" West and <br />parallel with the centerline of Detroit Avenue a distance of <br />20.81 feet to a point, said point being the principal place <br />of beginning; <br /> <br />Thence South 0° 04' 40" East along the westerly right of way <br />line of Rockway Avenue a distance of 295.09 feet to a point; <br />Thence South 89° 55' 20" West a distance of 105.10 feet to a <br />point; Thence South 00° 00' 00" East a distance of 40.00 feet <br />to a point, Thence South 86° 18' 04" West a distance of 132.28 <br />feet to a point, Thence South 00° 00' 00" East a distance of <br />52.01 feet to a point, Thence South 90° 00' 00" West a distance <br />of 115.00 feet to a point in the easterly line of Wayne Avenue, <br />50 feet wide; Thence North O0° 00' 00" East along the easterly <br />right of way line of said Wayne Avenue a distance of 294.41 feet <br />to a point in the southerly line of aforementioned Detroit Avenue; <br />Thence North 73° 55' 20" East and parallel with the centerline <br />of Detroit Avenue a distance of 366.02 feet to a point, being <br />the principal place of beginning, be the same more or less but <br />subject to all legal highways. All bearings are on an assumed <br />meridian. <br /> <br />shall be and the same is hereby reclassified and changed from Use Classification <br />R-2 (one family district) to B-2 (retail district); provided, however, that when <br />and if the above described premises shall be developed as a cultural center, <br />ninety (90) off-street parking spaces shall be provided for such center. <br /> <br /> Section 2. That Section 1103.04 of the Zoning Code of the Codified <br />Ordinances of the City of Lakewood is hereby amended by changing and revising <br />the Building Line Map to the extent that the building line or set back line for <br />the property described in Section 1 of the within Ordinance shall be changed <br />from 15 feet to 8-feet for that portion of the property fronting on Rockway <br />Avenue, and from 20 feet to 8 feet for that portion of said property fronting <br />on Wayne Avenue. <br /> <br /> Section 3. The City Engineer is hereby authorized and directed to make <br />said changes in the Zoning Map and the Building Line Map of the City of Lakewood, <br />Ohio so as to reflect the amendments designated in Section 1 and Section 2 of this <br /> <br />Ordinance. <br /> <br /> Section 4.
