McBride, Sinagra, Usher, <br />Brockman, Chinnock, Magnotto <br /> <br /> AN EMERGENCY ORDINANCE to am'end Paragraph (b) of Section 339..11 of <br />the Codified Ordinances of the City of Lakewood relating to the use of studded <br />tires. <br /> <br /> WHEREAS, the Legislature of the State of Ohio recA. t~ntly amended the <br />law relating .to the use of' studded tires so as to extend the period of time <br />during which the use of studded tires is permitted, and <br /> <br /> WHEREAS, the section of the Lakewood Traffic Code relating to studded <br />tires should be amended so as to conform to the State law, and <br /> <br /> WIlEREAS, this Ordinance constitutes an emergency measure providing <br />for the in~nediate preservation of the public health, safety and welfare and <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF TI-Hg CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That paragraph (b) of Section 339.1.1 of the Traffic Code <br />of the Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />339.11 USE OF STUDDED TIRES AND CI~INS. <br /> <br />(b) <br /> <br />No person shall operate any motor vehicle, other than a public <br />safety vehicle or school bus, that is equipped with studded <br />tires on any street or highway, except during the periocr', <br />extending from November 15 of each year through March 15 ef <br />the succeeding year. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />339.11 USE OF STUDDED TIRES AND 'CI. LAINS. <br /> <br />(b) <br /> <br /> No person shall operate any motor vehicle, other than a public <br /> safety vehicle or school bus, that is equipped with studded <br /> tires on any street or highway in this city , except during the <br />. period extending from the first day of November of each year <br /> through the fifteenth day of April of the succeeding year. <br /> <br /> Section 2. That this Ordinance is hereby declared to bc an e~nergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor, and existing paragraph (b) of Section 339.11 adopted February 18, 1975 <br />shall be and the same is he.reby repe'~led. ~~ ~///~ <br /> vice Pre sident~ <br /> <br />Approved:~.'~. <br /> <br />Mayor <br /> <br /> <br />
