<br /> AN EMERGENCY ORDINANCE authorizing the Mayor~, on behalf of the
<br />City of Lakewood, to purchase the certain real estate located at 1448 Warren
<br />Road, Lakewood, hereinafter more particularly described, together with all
<br />personal property situated thereon.
<br />
<br /> WHEREAS, on October 6, 1975 this council adopted Resolution NO. 5098
<br />declaring the necessity and intent of the City of Lakewood to appropriate the
<br />fee simple interest in and to the real property located at 1448 Warren Road,
<br />Lakewood, Ohio Owned by The Lakewood Drive-In Company, an Ohio corporation, and
<br />
<br /> WHEREAS, subsequent to the adoption of said Resolution the owners of
<br />said real property have agreed to sell same to the City for One Hundred Seventy
<br />Thousand Dollars ($170,000.00), including the personal property situated t. here~n
<br />and,
<br />
<br /> WNEREAS, this Council determines that said purchase price is fair,
<br /> just and equitable and it is in the best interest of the City to acquire said
<br />'property to be used for municipal purposes, and
<br />
<br /> WHEREAS, this Ordinance constitutes an emergency measure providing
<br />for the immediate preservation of the Public health, safety and welfare and
<br />for the usual daily operation of a municipal department, and for the further
<br />reason that the the owner has agreed to sell said property for the considera-
<br />tion herein stipulated and it. is in the best interest of the City to acquire
<br />the property at the earliest possible time; now, therefore,
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That the Mayor be and he is hereby authorized and directed
<br />to enter into a purchase agreement with The Lakewood Drive-In Company, an Ohio
<br />corporation, to purchase from said Lakewood Drive-In Company, an Ohio corporation,
<br />the following described property, together with all personal property situated
<br />thereon:

<br />Situated in the City of Lakewood, County of Cuyahoga and State of
<br />Ohio and known as being all of Sublot No. I and part of Sublot
<br />No. 2 in J. E. Tegardine Subdivision of part of O~iginal Rockport
<br />Township Section No. 22, as shown by the recorded plat in Volume
<br />29 of Maps, Page 19 of Cuyahoga County Records, and part of Original
<br />Rockport Township Section No. 22, bounded and described, as follows:

<br />Beginning in the Westerly line of Warren Road, at the Southeasterly
<br />corner Of said Sublot No. 1; thence Northerly along the Westerly
<br />line of Warren Road, 76 feet to a point 30 feet Northerly measured
<br />along said Westerly line ~f Warren Road from the Northeasterly corner
<br />of said Sublot No. 1; thence Westerly parallel to and 30 feet Northerly
<br />from the Northerly line of Sublot No. 1, a distance of 168 feet; thence
<br />Westerly about 121 feet to a point in the Easterly line of Victoria
<br />Avenue, which point is 88 feet North on said Easterly l£ne from the
<br />Northwesterly corner of property of Board of Education; thence Southerly
<br />on the Easterly line of Victoria Avenue 88 feet to the Northwesterly
<br />corner of property of Board of Education; thence Easterly on said
<br />Northerly line and along the. Southerly line of said Sublot No. 1,
<br />about 284.68 feet to the place of beginning, be the same more or less,
<br />but subject to all,legal highways.

<br />and to pay therefor the sum of One Hundred Seventy Thousand Dollars ($170,000.00).
