Please substitute for Ordinance 28-76 <br />which Ordinance was put on first reading <br />and referred to the Planning & Zoning <br />Committee and Finance Committee on April <br />'~19, 1976. <br /> <br />ORDINANCE NO. 28-76 <br /> <br />BY: Messrs. McBride, Salmon, Sinagra, <br /> Usher, Brockman, Chinnock, Msgnotto <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor, on ·behalf <br />of the City of Lakewood, to advertise for informal proposals for the sale or <br />lease of the Hopkins Avenue Fire Station and determining that it is in the best <br />interest of the City that said property be sold or leased. <br /> <br /> WHEREAS, the City of Lakewood is the owner of certain r.eal estate <br />designated as Permanent Parcel No. 315-10-141 of the Records of Cuyahoga County, <br />at which location is situated the Hopkins Avenue Fire Station, and <br /> <br /> WHEREAS,. with the construction of the new Fire Station on Clifton <br />Boulevard the said Hopkins Avenue Fire Station is no longer needed by the Fire <br />Department and is currently standing vacant, and <br /> <br /> WHEREAS, it is in the best interest of the City to advertise for <br />informal proposals for the sale or lease of said building so that the City may <br />secure the best disposition possible for the City and at the same time preserve <br />the existing character of the neighb.orhood, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety and welfare and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STA~E OF OHIO: <br /> <br /> Section 1. That this Council determines that the Hopkins Avenue Fire <br />Station situated on Hopkins Avenue should be sold or leased and that such sale <br />or lease is in'the best interest of this City. <br /> <br /> Section 2. That this Council determines that the sale or lease of the <br />aforementioned Hopkins Avenue Fire Station will further the interests of this <br />City and its residents. <br /> <br /> Section 3. That the Mayor of the City of Lakewood be* and he is hereby <br />authorized to advertise for informal proposals for the sale or lease of the <br />Hopkins Avenue Fire Station located on Hopkins Avenue in the City of Lakewood <br />and designated Permanent Parcel No. 315-10-141 of the Records of Cuyahoga County, <br />Ohio. <br /> <br /> Section 4. Said advertisement shall state that any contract for the <br />sale or lease of said property shall, be subject to the approval of Council and <br />that all persons making a proposal shall submit a statement detailing their <br />intended use of the building and the property. Proposals received by the <br />Administration shall be opened upon receipt and. copies of all proposals shall <br />be available to members of Council. It is the intent of this Council that all <br />proposals received may be subject to further negotiation and evaluated based on <br />the monetary consideration offered and the impact on the existing character of <br />the neighborhood and the property disposed of in the manner determined to be in <br />the best interest of the City. <br /> <br /> Section 5.
