ORDINANCE NO.: 48-76 BY: <br /> <br />Magnotto, McBride, Sinagra, <br />Usher, Brockman <br /> <br /> AN EMERGENCY ORDINANCE, authorizing and directing the Director of <br />Public Works to employ by contract, the firm of H W H Associates, Inc., <br />1150 West Third Street, Cleveland, Ohio 44113, as consulting engineers for <br />the purpose of preparing construction drawings, contract documents and <br />specifications for the rehabilitation of the electrostatic precipitator <br />cooling tower and associated ductwork at the Lakewood Municipal Incinerator. <br /> <br /> WHEREAS, this Council determines that it is necessary to provide <br />the necessary rehabilitation for the gas cleaning equipment on the Lakewood <br />Municipal Incinerator to prevent structural failure and provide continuing <br />operation and, <br /> <br /> WHEREAS, this Council determines that the American Air Filter <br />Company, Inc. refuses to accept responsibility for this work, and, <br /> <br /> WHEREAS, this Council determines that it is necessary to employ <br />the services of a consulting engineer to provide the necessary plans and <br />specifications for the construction of this work, and, <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public peace, property, health, and <br />safety and for the usual daily operation of a municipal department., now, <br />therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1, That the Director of Public Works be, and he is hereby <br />authorized and directed to employ by contract the firm ~f H W H Associates, <br />Inc., 1150 West Third Street, Cleveland, Ohio 44113, as consulting engineers <br />for the purpose of furnishing all engineering design and drafting services <br />for this project. These services will consist of the study of solutions <br />to the high rate of corrosion experienced in this equipment with recommenda- <br />tions for the final design, the preparation of detailed construction plans, <br />specifications, estimates of cost and contract documents complete for bidding. <br />Said contract shall be based upon the proposal submitted by the said H W H <br />Associates, Inc., dated June 29, 1976, and shall provide for a fee to be <br />computed in accordance with said proposal. <br /> <br /> Section 2. That this Ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor. <br /> <br /> Clerk,,,/ <br /> <br />Approve~~ ~, <br /> <br />Mayor <br /> <br /> <br />
