ORDINANCE NO. 71-76 <br /> <br />BY: Messrs. Salmon, Sinagra, Usher, <br /> Brockman, Chinnock <br /> <br /> AN EMERGENCY ORDINANCE to appropriate property at and known as being <br />12600 Detroit Avenue, Lakewood, Ohio. <br /> <br /> WHEREAS, on the 6th day of December, 1976,.the Council of the City of <br />Lakewood, Ohio adopted Resolution No. 5179 declaring the necessity and intention <br />of appropriating the land hereinafter described, notice of the adoption of which <br />resolution has been served on the owners, persons in possession or having an <br />interest of record in said land, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the fee simple interest in and to the following des- <br />cribed real estate be and the same is hereby appropriated for the purpose of <br />using same for a municipal parking facility for the City of Lakewood, Ohio: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and State <br />of Ohio: <br /> <br />And known as being part of Original Rockport Township Section <br />No. 21, and bounded and described as follows: <br /> <br />Beginning in the Westerly line of Lakewood Avenue, as dedicated <br />in Volume 81 of Maps, Page il of Cuyahoga County Records, thirty- <br />five (35) feet wide, the Westerly line of which is parallel with <br />and distant thirty-five (35) feet Westerly from the Easterly line <br />of premises conveyed to William Bozett and Eliza M. Cochran by <br />Deed dated December 21, 1909, and recorded in Volume 1226, Page <br />64 of Cuyahoga County Records at the point of intersection of <br />said Westerly line of Lakewood Avenue with the Northerly line of <br />Detroit Avenue; thence Northerly along the Westerly line of <br />Lakewood Avenue, 74.79 feet; thence Westerly about 95.26 feet <br />to a point in the Westerly line of said land so conveyed to <br />William Bozett and Eliza M. Cochran as aforesaid 62.66 feet <br />Northerly from the Northerly line of Detroit Avenue, measured <br />along said Bozett and Cochran'.s Westerly line; thence Southerly <br />along said Westerly line 62.66 feet to the Northerly line of <br />Detroit Avenue; thence Easterly 96.09 feet to the place of <br />beginning, and being further known as parts of Sublots Nos. <br />One (1) and Two (2) in P. W. Cochran's proposed subdivision <br />of part of Original Rockport Township, Section No. 21, be the <br />same more or less but subject to all legal highways. <br /> <br /> Section 2. That the Director of Law be and he is hereby authorized and <br />directed to apply to a court of competent jurisdiction to have a jury impanelled <br />to make inquiry into and assess the compensation to be paid for the fee simple <br />interest in said property. <br /> <br /> Section 3.
