ORDINANCE NO. 71-76 BY: Messrs. Salmon, Sinagra, Usher, Brockman, Chinnock AN EMERGENCY ORDINANCE to appropriate property at and known as being 12600 Detroit Avenue, Lakewood, Ohio. WHEREAS, on the 6th day of December, 1976,.the Council of the City of Lakewood, Ohio adopted Resolution No. 5179 declaring the necessity and intention of appropriating the land hereinafter described, notice of the adoption of which resolution has been served on the owners, persons in possession or having an interest of record in said land, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the fee simple interest in and to the following des- cribed real estate be and the same is hereby appropriated for the purpose of using same for a municipal parking facility for the City of Lakewood, Ohio: Situated in the City of Lakewood, County of Cuyahoga and State of Ohio: And known as being part of Original Rockport Township Section No. 21, and bounded and described as follows: Beginning in the Westerly line of Lakewood Avenue, as dedicated in Volume 81 of Maps, Page il of Cuyahoga County Records, thirty- five (35) feet wide, the Westerly line of which is parallel with and distant thirty-five (35) feet Westerly from the Easterly line of premises conveyed to William Bozett and Eliza M. Cochran by Deed dated December 21, 1909, and recorded in Volume 1226, Page 64 of Cuyahoga County Records at the point of intersection of said Westerly line of Lakewood Avenue with the Northerly line of Detroit Avenue; thence Northerly along the Westerly line of Lakewood Avenue, 74.79 feet; thence Westerly about 95.26 feet to a point in the Westerly line of said land so conveyed to William Bozett and Eliza M. Cochran as aforesaid 62.66 feet Northerly from the Northerly line of Detroit Avenue, measured along said Bozett and Cochran'.s Westerly line; thence Southerly along said Westerly line 62.66 feet to the Northerly line of Detroit Avenue; thence Easterly 96.09 feet to the place of beginning, and being further known as parts of Sublots Nos. One (1) and Two (2) in P. W. Cochran's proposed subdivision of part of Original Rockport Township, Section No. 21, be the same more or less but subject to all legal highways. Section 2. That the Director of Law be and he is hereby authorized and directed to apply to a court of competent jurisdiction to have a jury impanelled to make inquiry into and assess the compensation to be paid for the fee simple interest in said property. Section 3.
