ORDINANCE NO. 8-77 <br /> <br />BY: Messrs. Magnotto, McBride, Salmon, <br /> Sinagra, Usher, Brockman, Chinnock <br /> <br />AN EMERGENCY ORDINANCE to supplement the Business Regulation Code <br />of the Codified Ordinances of the City of Lakewood by enacting new paragraph <br />(h) of Section 769.09 of said Code to require operators of taxicabs within <br />the City of Lakewood to maintain a written record of each trip made by such <br />operator. <br /> <br /> ~tEREAS, the owners of taxicabs operating within the CitY of Lakewood <br />are contemplating altering their method of operation to provide for the leasing <br />of their taxicabs to drivers who will be independent contractors of the taxicab <br />company and not employees, and <br /> <br /> WHEREAS, under such a leasing arrangement the taxicab company will no <br />longer have authority to require the operators of its taxicabs to maintain a <br />record of each trip made by the operator, and <br /> <br /> WHEREAS, it is for the best interests of the City of Lakewood to require <br />operators of tsxicabs within the City to maintain such written records to verify <br />whether or not fares have been charged contrary to the City's ordinances, and for <br />many other reasons, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure for the reason <br />that it provides for the usual daily operation of a municipal department and also <br />because it is necessary to grant the Director of Public Safety such power and <br />authority by reason of the imminent change in the method of business operation <br />of taxicab companies operating within the City of Lakewood; now, therefore; <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 769.09 of the Business Regulation Code of the <br />Codified Ordinances of the City of Lakewood be and the same is hereby supplemented <br />by enacting new paragraph (h) to said section to read as follows: <br /> <br />769.09 PROHIBITED ACTS <br /> <br />No taxicab company or driver shall: <br /> <br />(h) Fail to maintain, for a period of three (3) years, a <br /> written record of each trip made by such company or <br /> driver, which record shall include the time and date <br /> each passenger is picked up, the destination, time of <br /> arrival at such destination, the amount of fare collec- <br /> ted for each trip and such other information as may be <br /> required by the Director. <br /> <br /> Section 2. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its ad~tion/~ and approval by the <br />Mayor.. <br /> <br /> Pr~id~t <br /> <br /> Mayor <br /> <br /> <br />
