<br /> AN EMERGENCY ORDINANCE tc amend 'Sections 505.07, 509.03 (a) (2),
<br /> 513.10 (b), 517.01, 517.02, 5!7.06~ 525.03, 525.05,:525.11, 529.02 (a) and
<br /> (b), 52~.07, 541.07 of the General~Offenses Code of the Codified Ordinances
<br /> of the City of Lakewood, to supplement the same by the enactment of new
<br /> Sections 5i3.01 (aa), 513.01 (bb), 513.11, 517.07, 517.08, 517.09, 517.10,
<br /> 525.15 and to repeal Section 529.08 thereof.
<br />
<br /> WHEREAS, the present General Offenses Code of the Codified Ordinances
<br /> of the City of Lak~wood was enacted so that the same was in compliance with the
<br /> applicable corresponding provisions of the Statutes of the State of Ohio, and
<br />
<br /> WHEREAS, subsequent to the enactment of the General Offenses ~ode of
<br />the Codified Ordinances of the City of Lakewood, Ohio the State Legislature has
<br />made certain revisions and additions to the various Statutes of the State governing
<br />general offenses, and
<br />
<br /> WHEREAS, this Council deems it to be in the best interest of all of the
<br />citizens of the Cit.y of Lakewood to revise the City's General Offenses Code to
<br />bring its provisions in compliance with current state Law as the same has been
<br />amended since the enactment of the present General Offenses Code, and
<br />
<br /> WHEREAS, this Ordinance constitutes an emergency measure providing for
<br />the immediate preservation of the public safety and Welfare and for the usual
<br />daily op,eration ~f a municipal department; now, therefo:e,
<br />
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> ~ Section 1. That Section 505.07 of the General Offenses Code of the
<br />Codified Ordinances of the City of Lakewood now readin, g as follows:
<br />
<br /> 505.07 CRUELTY q~) ANIMALS.
<br /> (a) No person shall overwork, overdrive, overload or torture an animal, deprive one
<br />of necessary sustenance, unnecessarily or cruelly beat, needlessly mutilate or kill, or
<br />impound or confine an animal without supplying it during s~ach confinement with a sufficient
<br />quantity of good wholesome food and water. No person shall carry or convey an animal
<br />in a cruel or inhuman manner, or keep animals in an enclosure without wholesome exercise
<br />and change of air, or feed animals food that is adulterated or unwholesome, or work or
<br />abandon to die an old, maimed, sick, infirm or diseased animal.

<br />
<br /> 505.07 C~:UELTY TO ANIMALS.
<br /> (a) No person shall:
<br /> (1) Torture an animal, deprive one of necessary sustenance, unnecessarily or
<br /> cruelly beat, needlessly mutilate or kill, or impound or confine an ,animal
<br /> without supplying it during such confinement with a sufficient quantity of good
<br /> wholesome food and water;
<br /> (2) hnpound or confine an animal without affording it, during such confinement,
<br /> access to shelter from wind, rain, snow or c.~ccssivc direct sunlight if it can
<br /> reasonably be cxlx.~(',l:cd that lhe animal would otherwise become sl(:k or in
<br /> s~,m,',,il-'r wa) suff~r. 'l'hl~ sul)scction (:0(2) docs nol. al,ply Io :~nlmals
<br /> impounded or confined prior to slaughter. For the purpose of this section,
<br /> ~ "shelter" means a man-made enclosure, windbreak, sunshade or natural
<br /> windbreak or sunshade IFat is developed from thc ear~'s contour, tree de-
<br /> velopment or vcgctati~m;
<br /> (3) Carry or convey an animal in a cruel or blhuman manner;
<br /> (4) Keep animals other than cattle, poultry or fowl, swine, sheep or goats in an
<br /> enclosure without wholesome exercise and change of air, nor feed cows on
<br /> food that produces impure or unwholesome milk;
<br /> (5) Detain livestock in raih'oad cars or compartments longer than twenty-eight
<br /> hours after they are so placed without supplying them with necessary food,
<br /> water and attention, nor permit such stock to be so crowded as to overlie,
<br /> ~ crugb, wound or kill each other.
