That Section 51].].1 of the General Offenses Code of the' <br />Cod±f ±ed 0rd~nances of the C±ty of Lakewood is hereby enacted to read as follows: <br /> <br /> 513.11 TRAFFI('KING IN tlARMI"UL INTOXICANTS. <br /> (a) No person stroll knowingly dispense or distribute any tntrm[ul intoxic,'mt except <br />gasoline to any person under eighteen years of age, if the person who dispenses or dis- <br />tributes it knows or has reason to believe that the harmful intoxic~mt will be used in viola- <br />tion of Section 513o07~ unless a writ:ten order from the parent or guardian i~ provided to <br />the dispenser or distributor. Six months afar the State Board of Pharmacy has designated <br />the noxious additive that is to be included in any product contJtining toluene, the gas, fumes <br />or vapor of which when inhaled can induce intoxication, excitement, giddiness, irrational <br />behavior, depression, stupefaction, paralysis, unconsciousness, asphyxiation~'~:or other <br />harmful physiological effects, no person shall dispense or distribute a product that is <br />required to include a noxious additive unless such product includes the noxious additive <br />tn the 'amounts and proportions prescribed by the Board. <br /> <br /> (b) Any pr(~lur't that is required by subse('tton (a) here, of to include a noxious additive <br />shall have such contents clearly stated on the label. If the offender has previously been convicted of a drug <br />abuse offense, trafficking in harmful IntoxiCants Is a misdemeanor of the third degree. <br /> <br /> (e) T'his section d(~.s not apply to products usc(l tn m:~king, fabricating, assembling, <br />transporting or constructing a product or structure by manual labor or machinery for sale <br />or lease to another perseus, or to the mining, refining or pr~x}essing of natural deposits. <br />(ORC 2925.32) <br /> <br /> Section 7. That Section 517.01 of the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood now reading as ~ollc,ws:' <br /> <br />517.01 DEFINITIONS. <br />As used in thislchaPter: <br />(a) <br /> <br />(c) <br /> <br />(d) <br /> <br />(e) <br /> <br />"Bookmaking" means the business of receiving or paying off bets. <br />"Bets" means the hazarding of anytlulng of value upon the result of an event, <br />undertaking or e0ntingency, but does not include a bona fide business risk. <br />"Scheme of chance" means a lottery, numbers game., pool or other scheme in <br />which a participant gives a valuable considerahon for a chance to win a prize. <br />"Game of chance" means poker, craps, roulette, a slot machine, a punch board <br />or other game in which a player gives anything of value in the hope of gain, the <br />outcome of which i J determined ~largely or wholly by chance. <br />"Scheme or game of chance conducted for profit" means any scheme or game of <br />~hance designed to produce income for its backer, promoter or operator, but <br />does not include any schcme, or game of chance dcsigned to produce, income solely <br />for charitable purposes when the entire net income after deduction of necessary <br />expenses is applied to such purposes. <br /> <br /> <br />
