ORDINANCE NO. 21-77 <br /> <br />BY: Messrs. McBride, SalmOn. Sinagra~ <br /> Usher, Brockman, Magnotto <br /> <br />AN ORDINANCE to amend Section 1116.09 and Section 1119.07.of the Zoning <br />Code of the Codified Ordinances of th~ City of Lakewood relating to rear <br />yards in the BR and th~ B2 districts. <br /> <br />BE IT 'ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That Section 1116.09 of the Zoning Code of the Codified <br />Ordin~ances of the City of Lakewood, now reading as follows: <br /> <br />Section 1116.09 REAR AND SIDE YARD REGULATIONS <br /> <br />(a) "No side yard or rear yard shall be required~where a building is <br /> devoted to uses other than residential." <br /> <br />· ~ (b) "In buildings that have or will have dwelling units, the side yard <br /> and rear yard shall be not less than one-half (½) the height of <br /> the building but in no case less than five (5) feet. Buildings! <br /> which do not require a rear yard may be constructed on the rear <br /> portion of the lot or parcel and the front part used for off <br /> street parking." <br /> <br />be the same is hereby amended so that as amended it shall read as follows: <br /> <br />Section 11i~.09 REAR AND SIDE YARD REGULATIONS <br /> <br />"Side yard and rear yard when abutting a lot with a residence on <br /> it or a residential district, shall be at least one-half the <br /> height of the building, but in no case less ~han five (5) feet." <br /> <br />Sectmon 2. T~at Section 1119.07 of the Zoning Code of the Codified <br />Ordinances of the City of Lakewood, now reading as follows: <br /> <br />SEction 1119.07 REAR YARD REGULATIONS <br /> <br />"The rear yard, when ab~tt~ng a lot with a resi'dence on it or a <br /> residential district, shall be at least one-half the height of <br /> the building, but in no case less than ten (10) feet." <br /> <br />be the same is hereby amended so that as amended it shall read as follows: <br /> <br />Section 1119.07 REAR YARD REGULATIONS <br /> <br /> ~"The rear yard, when abutting a lot with a residence on it or a <br /> residential district, shall be at least one-half the height of <br /> the building, but in no case less than five (5) feet." <br /> <br />Section 3. That this ordinance shall take effect and be in force from and <br />after the earliest period allowed by law and ~ ordinances or parts of <br />ordinances ihconsistent herewith are hereby r~ealed. <br /> <br />Adopted: <br /> <br />Mayor <br /> <br /> <br />
