ORDINANCE NO. 35-77 BY: <br /> <br />Messrs. Brockman, Chinnock, McBride, <br />Salmon, Sinagra, Usher <br /> <br /> AN EMERGENCY ORDINANCE approving a Collective Bargaining Agreement with <br />District Council 78 and Local 1043 of the American Federation of State, Coun'ty and <br />Municipal Employees AFL-CIO establishing conditions of employment, working conditions <br />and various benefits for certain employees of the Department of Public Works of <br />the City of Lakewood and authorizing the Mayor and the Director of Public Works <br />to sign said Agreement on behalf of the City. <br /> <br /> WHEREAS, a prior Collective Bargaining Agreement entered into between <br />the City of Lakewood and District Council 78 and Local 1043 of the American Federa- <br />tion of State, County and Municipal Employees AFL-CIO terminated on February 28, <br />1977, and <br /> <br /> WHEREAS, discussions and negotiations have been continued subsequent on <br />behalf of the City with representatives of Local Union 1043 and District Council 78 <br />with respect to conditions of employment, working conditions, and various benefits <br />for certain employees of the Department of Public Works of the City of Lakewood, <br />and <br /> <br /> WHEREAS, agreement has been reached in the course of said discussions <br />and negotiations with respect to the conditions of employment, working conditions <br />and various benefits for certain employees aforementioned, and <br /> <br /> WHEREAS, this Council determines that it is in the best interest of the <br />City to approve said Collective Bargaining Agreement and authorize the Mayor and <br />Director of Public Works to sign same on behalf of the City, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety and welfare and for the <br />usual daily operation of a municipal department, and for the further reason that <br />it is necessary to approve said Agreement at the earliest possible time, now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Collective Bargaining Agreement with District Council <br />78 and Local 1043 of the American Federation of State, County and Municipal Employees <br />AFL-CIO dated July 12, 1977, and effective for the period March 1, 1977, to February <br />28, 1979, an original copy of which is on file in the Office of the Mayor of the <br />City of Lakewood and is made a part hereof as though written fully herein, is hereby <br />adopted, ratified and approved and the Mayor and the Director of Public Works are <br />hereby authorized and directed for and on behalf of the City of Lakewood to affix <br />their signatures thereto. <br /> <br /> Section 2. That al~ other ordinances or resolutions or parts of ordinances <br />or resolutions which are inconsistent with the provisions of this ordinance and/or <br />the Collective Bargaining Agreement made a part hereof, are hereby repealed as of <br />March 1, 1977, to the extent that they pertain to the employees in the bargaining <br />unit covered by the Collective Bargaining Agreement and are inconsistent with this <br />ordinance, including the Collective Bargaiding Agreement referred to herein and <br />made a part hereof. <br /> <br /> Section 3.
