<br /> AN EMERGENCY ORDINANCE to enact a new Chapter 516 of the General
<br />Offenses Code of the Codified Ordinances of the City of Lakewood to establish
<br />a Fair Housing Code, and to repeal Ordinance No. 11-77 adopted April 18, 1977.
<br />
<br /> WHEREAS, the population of the City of Lakewood, Ohio, includes people of
<br />different races, colors, creeds, sexes, religious beliefS and nationalorigins, and
<br />
<br /> WHEREAS, the Council of the City of Lakewood believes in the principle
<br />of equal rights and privileges for all citizens, and
<br />
<br /> WHEREAS, the Federal and State legislative branches of government have
<br />adopted policies to provide, within constitutional limitation, for fair
<br />housing throughout our country, State and its political subdivisions, and
<br />
<br /> WHEREAS,.this Ordinance constitutes an emergency measure providing for
<br />the immediate preservation of public welfare and to provide for the usual
<br />daily operation of a municipal department, now therefore,
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:

<br /> Section 1. That the General Offenses Code of the Codified Ordinances
<br />of the City of Lakewood be and the same is hereby supplemented by enacting
<br />new Chapter 516 thereof to read as follows:

<br />CHAPTER 516
<br />FAIR HOUSING
<br />
<br />516.01 - POLICY.
<br />
<br /> That it is hereby designated to be the continuing policy of the City
<br />of Lakewood~to do all things necessary and proper to secure for all
<br />citizens their right to equal housing opportunities regardless of their
<br />race, color, creed, sex, religious belief or national origin.
<br />
<br />516.02 - SCOPE.
<br />
<br /> The provisions of this Chapter shall apply to all housing located
<br />within territorial limits of the City of Lakewood, State of Ohio.
<br />
<br />516.03 - DEFINITIONS.
<br />
<br />As used .in this Chapter:
<br />
<br /> a) "Director" means the Director of Community Development for the
<br />City of Lakewood.
<br />
<br /> b) "Dwelling" means any building, structure, or portion thereof which
<br />· is occupied as, or designed or intended for occupancy as a residence by
<br />one or more famil.ies, and any vacant land which is offered for sale or
<br />lease for the construction or location thereon of any such building,
<br />structure or portion thereof.
<br />
<br />c) "Family" includes a single individual.
<br />
<br /> d) "Person" includes one or more individuals, corporations, partnerships,
<br />associations, labor organizations, legal representatives, mutual companies,
<br />joint stock companies, trusts, unincorporated organizations, trustees in
<br />bankruptcy, receivers and fiduciaries. It also includes, but is not limited
<br />to any owner, leasor, assignor, builder, manager, broker, salesman, agent,
<br />employee, lending institution, and the City of Lakewood, the State and all
<br />authorities, agencies, boards and commissions thereof.
<br />
<br /> e) "Discrimination" means to.render any difference in treatment to any
<br />person in the sale, lease, rental or financing of a dwelling or housing unit
<br />because of a person's race, color, creed, sex, religious belief or national
<br />origin.
