49-77 Increase structural adequacy of pavement on Hilliard/Franklin

- 2 - (d) Enact no rule or regulation restricting the use of the improved road and/or structure by any class of vehicle or vehicle load permitted by the Ohio Revised Code to use a public highway; any existing rule or regulation so restricting road usage is hereby rescinded. Section 5. (Traffic Control). That traffic control devices will not be installed on the project without prior approval by the County and/or the Depart- ment of Transportation, State of Ohio, and the Municipality will place and maintain all traffic control devices conforming to the Ohio Manual of Uniform Traffic Con- trol Devices on the improvement in compliance with the provisions of Section 4511.11 and related sections of the Ohio Revised Code. Section 6. (Right-of-Way, Utility Rearrangement). (a) That all existing street and public right-of-way within the Municipality which is necessary for the aforesaid improvement shall be made available therefor. (b) (c) That the County will acquire additional right-of-way if required, for the rehabilitation of the aforesaid bridge. That arrangements have been or will be made with and agreements obtained from all public utility companies whose facilities will be affected by the said improvement and said Companies have agreed or will agree to make any and all necessary rearrangements of facilities in such a manner as to be clear of any construction called for by the plans of said improvement and said companies have agreed or will agree to make such h&cessary rearrangements immediately after notification by said Municipality or the County of Cuyahoga. (d) That it is hereby agreed that the Municipality shall at its own expense make all rearrangements of water mains, sanitary sewers, or other municipally owned utilities and/or any appurtenances thereto as may be necessary to conform to the said improvement and said rearrangements shall be done at such time as requested by the County. Approved: (e) That the construction, reconstruction, and/or rearrangement of both publicly and privately owned utilities, referred to in sub- sections (c) and (d) above, shall be done in such a manner as not to interfere unduly with the operation of the contractor constructing the improvement and all backfilling of trenches made necessary by such utility rearrangements shall be perfomed in accordance with the provisions of the Ohio Department of Transportation Construction and Material Specifications and shall be subject to approval by the County. Section 7. That this oPdinance is hereby declared to be an emergency measure for the reasons stated .in the preamble hereof and provided it receives the affirmative vote of two-thirds.bf all me~ers elected to Council, it shall take effect and be in force i~ediately upon its adoption and approval by the ~yor, othe~ise it shall take effect and be in force from and after the earliest period allowed by law.
