ORDINANCE NO. 50-77 BY: Messrs. Br'ockman, Chinnock, Magnotto, McBride, Salmon, Sinagra, Usher AN EMERGE~NCY ORDINANCE to amend Section 331.17 of the Traffic Code of the Codified Ordinances of the City of Lakewood pertaining to right of way ~hen turning left. · WHEREAS, the present Traffic Code of the Codified Ordin~nc~s~ of the City of Lakewood was enacted so that the same was generally in compli~'~ce with the applicable corresponding provisions of the State of Ohio, and WHEREAS, subsequent to the enactment of the Traffic Code the State Legislature amended the statute pertaining to right of way when turning left, and WHEREAS, this Council is of the opinion that the corresponding section of the City's Traffic Code ought to be brought into compliance with the current state law as the same has been amended since the enactment' of the present Traffic Code,~nd WHEREAS, this Ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare and' for the usual daily operation of a municipal department; now~ therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF' OHIO: Section 1. That Section 331.17 of the Traffic Code of the Codified Ordinances of the City of Lakewood now reading as follows: 331.17 RIGHT OF WAY'WHEN TURNING LEFT The operator of a vehicle intending to turn to the left within' an intersection or .into an alley, private road or driveway shall yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an i~ediate hazard. shall be and the same is hereby amended .to read as follows: 331.17 RIGHT OF WAY WHEN TURNING LEFT The operator of a vehicle intending to turn to the left within an intersection, or into an alley, private road or driveway, shall yield the right of way to any vehicle approaching from the opposite direction whenever the approaching vehicle is within the intersection or so close to the intersection, alley, private road or driveway as to constitute an immediate hazard. Section 2. That this Ordinance is hereby declared to be an'emergency measure for the reasons stated in thp preamble hereof and provided it ~eceives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon. its adoption and approval by.the Mayor; oth'erwise it shall take effect and~be in force from and after the earliest period allowed by law, and existing Section 331.17 shall be and the same is hereby repealed.
