Brockman, Magnotto~ <br /> McBride, Salmon, Sinagra, Usher <br /> <br />AN ORDINANCE to amend and supplement Section 1123.14 of the Zoning Code of the <br />Codified Ordinances of the City of Lakewood to permit Churches as a special ex- <br />ception in tile Business Residential BR and the Retail. B2 Districts and to per- <br />mi~t as a special exception Ch.rch-re]ated uses in all districts contiguous to <br />the Bnsiness Residential BR and Retail B2 Districts provided certain conditions <br />are met. <br /> <br />WqlEREAS, the City Council is desirous of permittinK Churches in the Business <br />Residential BR and the Retail B2 Districts as special exceptions and <br /> <br />WqtEREAS, the City Council has already ,,nde provisions for Church-related <br />uses in Districts contiguous to the Retail B2 and <br /> <br />~{EREAS, it is in the best interest of the residents.of the Community that <br />provisions be made to permit Churches under.special conditions; now, there- <br />fore, <br /> <br />BE IT ORDAINED BY TIlE COUNCIL OF TtIE CITY OF LAKEWOOD, STATE OF OtlIO: <br /> <br />Section 1. That Section 1123.1.4 of the Zoning Code of the Codified Ordinances <br />of the City of Lakewood now reading as follows: <br /> <br />1123.14 SPECIAL EXCEPTIONS <br /> <br />~e following uses if approved hy the Board of Zoning Appeals after public <br />notice and public hearing may he permitted as a special exception provided <br />that the conditions hereinafter specified are met: <br /> <br />(a) <br /> <br />Church buildings including Cht, rch educational buildings, parish houses, <br />church offices, recreational facilities and off-street parking for <br />church uses only, provided: <br /> <br />(1) <br /> <br />Tile parcel of land for which the special exception is requested <br />must be contiguous to a parcel classified Retail District B-2 <br />under the provisions of this Code. <br /> <br />(2) <br /> <br />(3) <br /> <br />(4) <br /> <br />No huilding, or port:lo, t:hereof, permitted hereunder shall be <br />used to cofiduct a business open to the public. <br /> <br />The side yard between the chUrch building and the lot line of <br />the abutting residential lot shall be not less than 10 feet. <br /> <br />The zoning regula,tions of the district in which this spec:ia1 <br />exception is being requested shall apply to the building proposed. <br /> <br />(5) Notice by ordinary mail of tile public hearing provided for herein <br /> shall be given t? tile owner Or owners of all property located <br /> within two hundred (200) feet of the property for which the <br /> special excePkion is requested. <br /> <br />(6) The Board of Zoning Appeals may prescribe conditions with re- <br /> spect to construction, mat. ntenance, fences, walls, off-street ' <br /> parking, driveways, landscaping, signs and such other conditions <br /> it deems necessary to protect the general welfare of the comanunity <br /> and the character of the neighborhood. <br /> <br />shall be and the same is hereby amended and supplemented to.read as follows: <br />1123.14 SPECIAL EXCEPTIONS FOR CilURCHES <br /> <br />R]~e following uses, if approved hy the Board of Zoni.g Appeals after pt,blic <br />notice and public hearing, n~y he permitted as special exceptions in the <br />Business Residential BR anti Retail B2 Districts, provided that the conditions <br />hereinafter specifie.d are met. ~ <br /> <br /> <br />
