ORDINANCE NO. 73-77 <br /> <br />BY: Messrs. Salmon, Brockman, Chinnock, <br /> McBride, Brown <br /> <br /> AN EMERGENCY ORDINANCE to supplement Part Thirteen of the Building <br />Code of the Codified Ordinances of the City of Lakewood by adopting and enacting <br />a new Chapter 1307 entitled "Flood Damage Prevention Code". <br /> <br /> WHEREAS, the. State of Ohio has, in Article XVIII of the Constitution, <br />delegated the responsibility to local governmental units to adopt regulations <br />designed to promote the public health, safety and general welfare of its <br />citizenry, and <br /> <br /> WHEREAS, the flood hazard areas of Lakewood are subject to periodic <br />inundation which results in loss of life and property, health and safety hazards, <br />disruption of commerce and governmental services, extraordinary public expendi- <br />tures for flood protection and relief, and impairment of the tax base, all of <br />which adversely affect the public health, safety and general welfare, and <br /> <br /> WHEREAS, it is the purpose of this Code to promote the public health, <br />safety and general welfare, and to minimize public and private losses due to <br />flood conditions in specific areas, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and <br />for the further reason that Council is of the opinion that this Ordinance must <br />become effective at the earliest possible date to take advantage of Federal <br />Assistance available; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Part Thirteen - Building Code of the Codified <br />Ordinances of the City of Lakewood, Ohio, be and the same is hereby supplemented <br />by adopting and enacting a new Chapter 1307 entitled "Flood Damage Prevention <br />Code" to read as follows: <br /> <br /> CHAPTER 1307 <br /> <br />FLOOD DAMAGE PREVENTION CODE <br /> <br />1307.01 TITLE <br /> <br />The provisions of this Chapter, hereinafter referred to as "this Code" shall <br />be known as the "Flood Damage Prevention Code of the City of Lakewood". <br /> <br />1307.02 FINDINGS OF FACT <br /> <br />(a) <br /> <br />The flood hazard areas of Lakewood are subject to periodic <br />inundation which results in loss of life and property, health <br />and safety hazards, disruption of commerce and governmental <br />services, extraordinary public expenditures for flood protec- <br />tion and.relief, and impairment of the tax base, all of which <br />adversely affect the public health, safety and general welfare. <br /> <br />(b) <br /> <br />These flood losses are caused by the cumulative effect of <br />obstructions in areas of special flood hazards which increase <br />flood heights and velocities, and when inadequately anchored, <br />damage uses in other areas. Uses that are inadequately flood- <br />proofed, elevated or otherwise protected from flood damage also <br />contribute to the flood loss. <br /> <br />1307.03 PURPOSE <br /> <br />It is the purpose of this Code to promote the public health, safety and general <br />welfare, and to minimize public and private losses due to flood conditions in <br />specific areas by provisions designed: <br /> <br /> <br />
