The term does not, however, include either: (1) any project for improvement of a structure to comply with existing state or local health, sanitary, or safety code specifications which are solely necessary to assure safe living conditions, or (2) any alteration of a structure listed on the National Register of Historic Places or a State Inventory of Historic Places. (h) "Variance" means a grant of relief from the requirements of this ordinance which permits construction in a manner that would other- wise be prohibited by this Ordinance. 1307.06 LANDS TO WHICH THIS CODE APPLIES This Code shall apply to all areas of special flood hazards within the juris- diction of Lakewood. 1307.07 BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZARD The areas of special flood hazard identified by the Federal Insurance Adminis- tration in a scientific and engineering report entitled "The Flood Insurance Study for the City of Lakewood", dated August 1, 1977, and February 1, 1978, with accompanying Flood Insurance Rate Maps is hereby adopted by reference and declared to be a part of this Code. The Flood Insurance Study is on file at 12650 Detroit Avenue, Lakewood, Ohio 44107. 1307.08 COMPLIANCE No structure or land shall hereafter be constructed, located, extended, converted or altered without full compliance with the terms of the Code and other applicable regulations. 1307.09 ABROGATION AND GREATER RESTRICTIONS This Code is not intended to repeal, abrogate, or impair any existing eastments, covenants, or deed restrictions. However, where this Code and any other code, ordinance, easement, covenant, or deed restriction conflict or overlap, whichever imposes the more stringent restrictions shall prevail. 1307.10 INTERPRETATION In the interpretation and application of this Code, all provisions shall be: (a) Considered as minimum requirements; (b) Liberally construed in favor of the governing body; and, (c) Deemed neither to limit nor repeal any other powers granted under state statutes. 1307.11 WARNING AND DISCLAIMER OF LIABILITY The degree of flood protection required by this Code is considered reasonable for regulatory purposes and is based on scientific and engineering considerations. Larger floods can and will occur on rare occasions. Flood heights may be increased by man-made or natural causes. This Code does not imply that land outside the areas of special flood hazards or uses permitted within such areas will be free from flooding or flood damages. This Code shall not create liability on the part of Lakewood, any office or employee thereof, or the Federal Insurance Administra- tion, for any flood damages that result reliance on this Code or any administra- tive decision lawfully made thereunder.
