The term does not, however, include either: <br /> <br />(1) <br /> <br />any project for improvement of a structure to comply with <br />existing state or local health, sanitary, or safety code <br />specifications which are solely necessary to assure safe <br />living conditions, or <br /> <br />(2) <br /> <br />any alteration of a structure listed on the National <br />Register of Historic Places or a State Inventory of <br />Historic Places. <br /> <br />(h) <br /> <br />"Variance" means a grant of relief from the requirements of this <br />ordinance which permits construction in a manner that would other- <br />wise be prohibited by this Ordinance. <br /> <br />1307.06 LANDS TO WHICH THIS CODE APPLIES <br /> <br />This Code shall apply to all areas of special flood hazards within the juris- <br />diction of Lakewood. <br /> <br />1307.07 BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZARD <br /> <br />The areas of special flood hazard identified by the Federal Insurance Adminis- <br />tration in a scientific and engineering report entitled "The Flood Insurance <br />Study for the City of Lakewood", dated August 1, 1977, and February 1, 1978, <br />with accompanying Flood Insurance Rate Maps is hereby adopted by reference and <br />declared to be a part of this Code. The Flood Insurance Study is on file at <br />12650 Detroit Avenue, Lakewood, Ohio 44107. <br /> <br />1307.08 COMPLIANCE <br /> <br />No structure or land shall hereafter be constructed, located, extended, converted <br />or altered without full compliance with the terms of the Code and other applicable <br />regulations. <br /> <br />1307.09 ABROGATION AND GREATER RESTRICTIONS <br /> <br />This Code is not intended to repeal, abrogate, or impair any existing eastments, <br />covenants, or deed restrictions. However, where this Code and any other code, <br />ordinance, easement, covenant, or deed restriction conflict or overlap, whichever <br />imposes the more stringent restrictions shall prevail. <br /> <br />1307.10 INTERPRETATION <br /> <br />In the interpretation and application of this Code, all provisions shall be: <br /> <br />(a) Considered as minimum requirements; <br /> <br />(b) Liberally construed in favor of the governing body; and, <br /> <br />(c) Deemed neither to limit nor repeal any other powers <br /> granted under state statutes. <br /> <br />1307.11 WARNING AND DISCLAIMER OF LIABILITY <br /> <br />The degree of flood protection required by this Code is considered reasonable <br />for regulatory purposes and is based on scientific and engineering considerations. <br />Larger floods can and will occur on rare occasions. Flood heights may be increased <br />by man-made or natural causes. This Code does not imply that land outside the <br />areas of special flood hazards or uses permitted within such areas will be free <br />from flooding or flood damages. This Code shall not create liability on the part <br />of Lakewood, any office or employee thereof, or the Federal Insurance Administra- <br />tion, for any flood damages that result reliance on this Code or any administra- <br />tive decision lawfully made thereunder. <br /> <br /> <br />
