(a) Residential Construction <br /> <br />New construction and substantial improvement of any residential <br />structure shall have the lowest floor, including ~asement, ele- <br />vated to or above base flood elevation. <br /> <br />(b) Nonresidential Construction <br /> <br />New construction and substantial improvement of any commercial, <br />industrial or other nonresidential structure shall either have <br />the lowest floor, including basement, elevated to the level of <br />the base flood elevation; or, together with attendant utility <br />and sanitary facilities, shall: <br /> <br />(1) <br /> <br />be floodproofed so that below the base flood level the <br />structure is watertight with walls substantially impermeable <br />to the passage of water; <br /> <br />(2) have structural components capable of resisting hydrostatic <br /> and hydrodynamic loads and effects of buoyancy; and <br /> <br />(3) <br /> <br />be certified by a registered professional engineer or <br />architect that the standards of this subsection are satisfied. <br />Such certifications shall be provided to the official as set <br />forth in Section 1307.14 (e) (2). <br /> <br />1307.19 FLOODWAYS <br /> <br />Located within areas of special flood hazard established in Section 1307.07 <br />are areas designated as floodways. Since the floodway is an extremely hazardous <br />area due to the velocity of flood waters which carry debris, potential projectiles, <br />and erosion potential, the following provisions apply: <br /> <br />(a) <br /> <br />Prohibit encroachments, including fill, new construction, <br />substantial improvements, and other development unless <br />certification by a registered professional engineer or <br />architect is provided demonstrating that encroachments shall <br />not result in any increase in flood levels during the occur- <br />rence of the base flood discharge. <br /> <br />(b) <br /> <br />If Section 1307.19 (a) is satisfied, all new construction and <br />substantial improvements shall comply with all applicable flood <br />hazard reduction provisions of Section 1307.17. <br /> <br /> Section 2. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force from and after the earliest <br />period allowed by law. <br /> <br />Approved: <br /> <br /> <br />
