ORDINANCE NO. ]04-78 BY: <br /> <br />McBride, Salmon, Wendling, <br />Brockman, Brown, Chinnock, <br />Magnotto <br /> <br /> AN t~E~GEN~ORDIN~E authorizing and directing the Mayor, <br />as ex-officio Director of Public Works, to enter into a contract with <br />the Cleveland Electric Illuminating Co. for electric street lighting <br />service. <br /> <br /> WHEREAS, pursuant to Resolution No. 532-8, adopted by this <br />Council on November 6, 1978, authorizing and directing the Mayor, as <br />ex-officio Director of public Works, to advertise for bids for furnishing <br />electric street lighting service for the City, the Cleveland Electric <br />Illuminating Co. submitted a propoSal dated November 24, 1978, and <br /> <br /> WHEREAS, said proposal is in the proper form and is the'lowest <br />and best bid, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the in~nediate preservation of the public health, safety and welfare for <br />the reason that such electric s~reet lighting is essential for the <br />protection of pedestrian and vehicular traffic within the City and provides <br />alSo for the usual daily operation of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEW0OD, STATE <br />OF OHIO: <br /> <br /> Section 1. That said proposal of the Cleveland Electric <br />IllUminating Co. for furnishing electric street lighting service in the <br />City of Lakewood be and the same is hereby accepted and the Mayo'r, as <br />ex-officio Director of Public Works, is hereby authorized and directed <br />to execute a contract in the name of the City with the .Cleveland Electric <br />Illuminating Co. for a period of nine (9) years from and after 12 Noon <br />of January 1, 1979 and from month to month thereafter for an additional <br />twelve (12) months, subject to cancellation upon written notice by the <br />Contractor ~o be given prior to April 1 in any year to be effectix~ <br />January 1 in the following year, at the prices and charges and in <br />.accordance with the terms and conditions specified in said proposal, <br />for installations described in Section 7a of the Specifications on file <br />in the office of the Clerk of the City of Lakewood. <br /> <br /> Section 2. 'That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members elected to <br />Council, it shall t.ake eff.ect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise it shall take effeCt and be in force <br />from and after the earliest period allowed by law.' <br /> <br /> ~ President /~// <br /> <br /> / ,/'-Mayor <br /> <br /> <br />
