The appeal shall be heard <br />by the Board of Building Stan~rds and Building Appeals, which <br />Board shall have the power after such hearing to either affirm <br />or overrule the decision of the Commissioner. The Board shall <br />cause notice of its decision to be sent by certified mail to the <br />applicant at the address of the applicant as set forth in the <br />application within thirty (30) days of the date of hearing. <br /> <br />1321.09 HOMEOWNERS EXCEPTION <br /> <br /> The provisions of this Chapter shall not apply to an owner <br /> desiring to perform work upon the premises occupied or to be <br />occupied by the owner thereof as such owner's established residence. <br /> Ail such work done shall be done by said owner with the assistance <br /> only of any member of his family or household, and said work shall <br /> be done in conformity with any applicable Code or Ordinance of the <br /> City of Lakewood, and no work shall be done unless all Permits, <br /> inspections and approvals required under any applicable Code or <br /> Ordinance of the City of Lakewood are secured. <br /> <br />1321.10 PENALTY <br /> <br /> Whoever violates any provision of this Chapter shall be guilty <br />of a misdemeanor of the third degree. If the offender has been <br />previously convicted of a violation of this Chapter, such second <br />or subsequent offense shall constitute a misdemeanor of the second <br />degree. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force inm~diately upon its adopt/on and approval by the <br />Mayor; otherwise it shall take effect andbe in force from and after the <br />earliest period allowed by law and at such time Ordinance No. 84-58 adopted <br />October 6, 1958 and all other ordinances or parts of ordinances inconsistent <br />herewith shall be and are hereby repealed. <br /> <br />Adopted: <br /> <br />President <br /> <br />Clerk <br /> <br />Approved: <br /> <br />Mayor <br /> <br /> <br />
