ORDINANCE NO. 22-78 BY: Messrs. Salmon, Usher, Brockman <br /> Brown,.Chinnock, Magnotto, <br /> McBride <br /> <br /> AN EMERGENCY ORDINANCE to supplement the Administrative Code of the <br />Codified Ordinances of the City of Lakewood by enacting new Section 149.19 <br />authorizing leaves of absence for temporary military active duty and the <br />payment of wages during such leaves. <br /> <br /> WHEREAS, under Ohio law, municipal employees who are members of the <br />Ohio National Guard, Ohio Defense Corps, Ohio Naval Militia, or members of <br />Other reserve components of armed forces of the United States are entitled <br />to leaves of absence without loss of pay for such time as they are on active <br />duty for periods not to exceed thirty-one (31) days in any one year, and <br /> <br /> WHEREAS, municipalities may provide for such leaves of absence and <br />establish a rate of pay calculated on the basis of the difference between City <br />pay and military pay, and <br /> <br /> WHEREAS, the agreement between the City and its service workers <br />already provides for the payment of the difference between regular pay and <br />military service pay for the members of the bargaining unit of Local Unit 1043 <br />and District Council 78 and this Council is of the opinion that such provision <br />is fair and equitable and should apply to all City employees to prevent inequity <br />between City employees, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department and for the further <br />reason that its immediate adoption is required to establish a fair rule, prevent <br />inequity among City employees, and to serve the requirements of public policy; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Administrative Code of the Codified Ordinances <br />of the City of Lakewood is hereby supplemented by enacting new Section 149.19 <br />thereof to read as follows: <br /> <br />SECTION 149.19 - MILITARY LEAVE AND COMPENSATION THEREFOR <br /> <br />(a) <br /> <br />(b) <br /> <br />Ail full-time, permanent, hourly employees and all annual, <br />salaried employees, including members of the Divisions of <br />Fire and Police shall be granted leaves of absence for <br />militarY duty in accordance with State and Federal law. <br /> <br />Any such employee of the City who is temporarily called <br />to active duty (e.g., summer training) shall be granted <br />a leave of absence for the duration of such active duty <br />and shall be paid the difference between his regular pay <br />and his service pay for a period not to eXceed thirty-one <br />(31) days in any one calendar year and shall accumulate <br />vacation, longevity and sick leave credit during the period <br />of such leave. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise it shall take effect and be in force from and after the <br /> <br />earliest period allowed~by law. <br /> <br />Adopted~~~ ~.-~.~ /? ff~' <br /> <br />Approved~~~ ~,, <br /> <br /> <br />
