Magnotto, McBride, Salmon, Ushe] Brockman, Brown AN F~IH~F~C7 ORDINANCE authorizing the Mayor on behalf o[ the City of ~Lkewood to enter into an agre(~mmt with the Director of ~'~msportation of the State of Ohio to improve Berea Road from Lakewood Heights Boulevard to West ll7th Street. WI{EILEAS, the Departmentof Transportation, State of Ohio, is considering the improvement of Berea Road from Lake~xxxi Heights ~ulevard to West ll7th Street, said portion of the work within the corporate limits of the City of Lakewood being hereinafter referred to as the improvement, and WI-~ZREAS, said improvement of Berea Road shall include the rehabilitation and resurfacing of the existing pavement wearing surface, the upgrading of traffic signals and corrective work on curbs as necessary, and M[EREAS, the public interest and safety d(:~and the improver~?nt of BereaRoad from Lakewood }~ights Boulevard to West ll7th Street, and WIPEREAS, this ordinance is hereby declared to be an emergency measure iiunediately necessary for the preservation of the public health, sa[ety .mid welfare ~md by remson of the need for ex~iting highway improvements to promote highway safety; now, therefore, BE IT ORDAINED BY R~[E COUNCIL OF ~ CITY OF I~Jfl6¥OOD, STATE OF OHIO: Section 1. (Consent) qhat it is declared to be in the public interost that the consent of the City of I~rkewcx)d be and such c. onsent is hereby given to the Director of Transportation to construct the al×)w~desc, ribod ~mprovc~aent, in accordance with plans, specifications and estimates as approved by the Director. Section 2. (Cooperation) That the City of Lakewood hereby proposes to cooperate with the State of Ohio, in the cost of the above-described improvement as follows: Asst~r~ and contribute the entire cost mid expense of the ir~prow~ment less the anDunt of Federal-aid Urban "M" funds set aside by the Director of Transportat~o~ 0nd the Northeast Ohio Areawide C~×)rdinating Agency (NOACA)for the financing of this in~)roveramt from funds allocated by the Federal Highway Administration, U.S. Department of Transportation. Section 3. (Authority to Sign) ~]at the Mayor of the City of lakewood is hereby ~m~3owered and directed on behalf of the City to enter into agreements with the Director of Transportation necessary to complete the planning and construction of this improvement. Section 4. (Maintenance and Parking) ~mt upon ~mpletion of said improvement the City of Lakewood will thereafter keep said highway open to traffic at all times, and (a) Maintain the improv(]uent :in accordance with the provisions oF t;h(~ stal:~tes relating t:h(~r(q:o :md make :m~)]e financial and other I)rOv~si(ms lT()r such ma int, cnance; and (b) Maintain the right-of-way and keep it free of obstructions in a manner satisfactory to the State of Ohio ,and hold said right-of-way inviolate for public highway purposes and permit no signs, posters, billboards, roadside stanck% or other private installations within the right-of-way limits; and (c) Place and maintain all. traffic control devices confonning to the Ohio Manual of Unifom~ Traffic Control Devices on the i~rovement in c(~npliamce with the provisions of Section 4511.11 and related sections of the Ohio Revised 'Code.
