Magnotto, <br /> McBride, Salmon, Ushe] <br />Brockman, Brown <br /> <br /> AN F~IH~F~C7 ORDINANCE authorizing the Mayor on behalf o[ the <br />City of ~Lkewood to enter into an agre(~mmt with the Director of ~'~msportation <br />of the State of Ohio to improve Berea Road from Lakewood Heights Boulevard <br />to West ll7th Street. <br /> <br /> WI{EILEAS, the Departmentof Transportation, State of Ohio, is <br />considering the improvement of Berea Road from Lake~xxxi Heights ~ulevard <br />to West ll7th Street, said portion of the work within the corporate limits <br />of the City of Lakewood being hereinafter referred to as the improvement, and <br /> <br /> WI-~ZREAS, said improvement of Berea Road shall include the <br />rehabilitation and resurfacing of the existing pavement wearing surface, <br />the upgrading of traffic signals and corrective work on curbs as necessary, <br />and <br /> <br /> M[EREAS, the public interest and safety d(:~and the improver~?nt <br />of BereaRoad from Lakewood }~ights Boulevard to West ll7th Street, and <br /> <br /> WIPEREAS, this ordinance is hereby declared to be an emergency <br />measure iiunediately necessary for the preservation of the public health, <br />sa[ety .mid welfare ~md by remson of the need for ex~iting highway <br />improvements to promote highway safety; now, therefore, <br /> <br />BE IT ORDAINED BY R~[E COUNCIL OF ~ CITY OF I~Jfl6¥OOD, STATE OF OHIO: <br /> <br /> Section 1. (Consent) <br /> <br /> qhat it is declared to be in the public interost that the consent <br />of the City of I~rkewcx)d be and such c. onsent is hereby given to the Director <br />of Transportation to construct the al×)w~desc, ribod ~mprovc~aent, in accordance <br />with plans, specifications and estimates as approved by the Director. <br /> <br /> Section 2. (Cooperation) <br /> <br /> That the City of Lakewood hereby proposes to cooperate with the <br />State of Ohio, in the cost of the above-described improvement as follows: <br /> <br />Asst~r~ and contribute the entire cost mid expense of the <br />ir~prow~ment less the anDunt of Federal-aid Urban "M" funds <br />set aside by the Director of Transportat~o~ 0nd the Northeast <br />Ohio Areawide C~×)rdinating Agency (NOACA)for the financing <br />of this in~)roveramt from funds allocated by the Federal <br />Highway Administration, U.S. Department of Transportation. <br /> <br /> Section 3. (Authority to Sign) <br /> <br /> ~]at the Mayor of the City of lakewood is hereby ~m~3owered and <br />directed on behalf of the City to enter into agreements with the Director of <br />Transportation necessary to complete the planning and construction of this <br />improvement. <br /> <br /> Section 4. (Maintenance and Parking) <br /> <br /> ~mt upon ~mpletion of said improvement the City of Lakewood will <br />thereafter keep said highway open to traffic at all times, and <br /> <br />(a) <br /> <br />Maintain the improv(]uent :in accordance with the provisions <br />oF t;h(~ stal:~tes relating t:h(~r(q:o :md make :m~)]e financial <br />and other I)rOv~si(ms lT()r such ma int, cnance; and <br /> <br />(b) <br /> <br />Maintain the right-of-way and keep it free of obstructions <br />in a manner satisfactory to the State of Ohio ,and hold said <br />right-of-way inviolate for public highway purposes and permit <br />no signs, posters, billboards, roadside stanck% or other <br />private installations within the right-of-way limits; and <br /> <br />(c) <br /> <br />Place and maintain all. traffic control devices confonning <br />to the Ohio Manual of Unifom~ Traffic Control Devices on the <br />i~rovement in c(~npliamce with the provisions of Section <br />4511.11 and related sections of the Ohio Revised 'Code. <br /> <br /> <br />
