ORDINANCE NO. 33-78 <br /> <br />BY: Messrs. Brockman, Brown, Chinnock, <br /> Magnotto, McBride, Salmon, Usher <br /> <br />AN EMERGENCY ORDINANCE to amend Section 137.04 of the Administrative Code <br />of the Codified Ordinances of the City of Lakewood relating to paid <br />holidays for members of the Division of Fire of the City of Lakewood. <br /> <br />WHEREAS, this ordinance constitutes an emergency measure, providing for the <br />usual daily Operation of municipal departments; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That existing Section 137.O4 of the Administrative Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />Section 137.04 HOLIDAYS <br /> <br />Members of the Division of Fire shall be granted as holidays New <br />Year's Day, Presidents' Day, Good Friday, Easter, Memorial Day, <br />Independence Day, Labor Day, Thanksgiving Day, Christmas Day and <br />Member's Birthday in the calendar year 1974 and each succeeding <br />calendar year thereafter. Members may be required to work on the <br />foregoing named holidays provided, however, that in the event any <br />member is required to work on any such holiday such member shall be <br />granted a day off, in lieu of such holiday. In the event any member <br />is off duty on any such holiday for any reason other than sick leave <br />or unexcused absence, such member shall be granted a day off, in <br />lieu of such holiday. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />Section 137.O4 HOLIDAYS <br /> <br />Members of the Division of Fire shall be granted twelve (12) holidays <br />to include New Year's Day, Presidents' Day, Good Friday, Easter, <br />Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Christmas <br />Day, the employee's birthday, and one twenty-four (24) hour off-duty period <br />classified as a personal business day, providing the employee works a <br />full year in which the holidays occur. The ten holidays shall be <br />granted in the form of five (5) twenty-four (24) hour off-duty periods <br />to compensate members for holidays actually worked. One of these <br />twenty-four (24) hour off-duty holidays may be divided upon request <br />into two (2) twelve (12) hour half holidays. All holiday off-duty <br />periods shall be selected in accord with the seniority plan. <br /> <br />Section 2. That this ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor and existing Section 137.04 adopted February 19, 1974 shall be and the <br />same is hereby repealed. <br /> <br />Approved: <br /> <br /> <br />
