ORDINANCE NO. 52-78 BY' Messrs. Brown, Chinnock, <br /> Magnotto, McBride, Salmon, <br /> B rockman <br /> AN EMEt~E~CY ORDINANCE to amend Section 128. 1502 of the <br />Administrative Code of the Codified Ordinances of the City of Lakewood <br />to increase the minimum penalty on unpaid Municipal Income Tax. <br /> <br /> WHERE., this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />OHIO: BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWODD, STATE OF <br /> <br /> Section 1. That Section 128.1502 of the ^dminiszratfve Code of <br />the Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />128.1502 PENALTIES ON UNPAID TAX <br /> <br />In addition to interest as provided in Section 128.1501 hereof, <br />penalties based on the unpaid tax or installments of estin~ated <br />tax are hereby imposed as follows' <br /> <br />(a) <br /> <br />For failure to pay taxes o~ estimated taxes due, other <br />than taxes withheld' ten per cent (10%) per annum, but <br />not less than $5.00. <br /> <br />(b) <br /> <br />For failure to remit taxes withheld from employees: ten <br />per cent (10%) per month or fraction thereof, but <br />accumulated penalty shall not exce~ fifty per cent <br />(50%) upon any unpaid amount and shall not be less <br />than $5.00. <br /> <br />be and the same is hereby amended to read ms follows: <br /> 128.1502 PENALTIES ON UNPAID TAX <br /> <br />In addition to interest as provided in Section 128.1501 hereof,'" <br />penalties based on the unpaid tax or installments of estimated <br />tax are hereby imposed as follows' <br /> <br />(a) <br /> <br />For failure to pay taxes or estimated taxes due, other <br />than taxes withheld' ten per cent (10%o) per annum, but <br />not less than $10.00. <br /> <br />(b) <br /> <br />For failure to remit ttLxes withheld fromm employees- ten <br />per cent (lOg) per month or fraction thereof, but <br />accumulated penalty shall not exceed fifty per cent <br />(50%) upon any unpaid amount and shall not be less <br />than $10~00. <br /> <br /> Section 2. 2]~is ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the prean~01e hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force irm~.~diately upon its adoption and approval by <br />the Mayor; otherwise it shall take effect at the earlJest periex~ allowed <br />by law, m~d existing Section 128.1502, adopted December 20, 1971, shall be <br />and the same is hereby repealed. <br /> <br /> ....c <br /> <br /> <br />
