ORDINANCE NO.: 93-78 <br /> <br />BY: Brown, Chinnock, Magnotto, <br /> McBride, Salmon, Wendling, <br /> Brockman <br /> <br /> AN EMERGENCYORDINANCE authorizing the settlement of the claim of <br />Robert A. Novak in the total amount of One T~ousandDollars ($1,000.00) <br />arising out of damages which allegedly occurred as a result of the refusal <br />of the City of LakewOOd to issue an occupancy permit. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure in that it <br />will save the City further legal expense and a possible verdict against the <br />City in an amount substantially in excess of the proposed settlement and <br />in that it provides for the usual daily operation of a municipal deparlment; <br />now~ therefore, <br /> <br />OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That settlement of the claim of Robert A. Novak, single, <br />in the amount of One Thousand Dollars ($1,000.00) is hereby ordered and <br />authorized conditioned upon the execution and delivery by Robert A. Novak <br />of a full release in favor of the City of Lakewood and all other n~med <br />defendants in the lawsuit currently pending in'the Court of Con, non Pleas <br />of CuyahogaCounty entitled, Robert A. Novak vs. City of Lakewood, et al <br />and designated as Case No. 78-980017 in said Court, duly approved by the <br />Director of Law. <br /> <br /> Section 2. That the Director of Finance be and he is hereby <br />authorized to pay the sum of One Thousand Dollars (SI,OD0.00) to Robert A. Novak, <br />single, upon delivery to the Director of Finance of the foregoing release duly <br />executed and approved, and to charge the same to the GENERAL FUND - DAMAGES. <br />PAID BY THE CITY. <br /> <br /> Section 3. That the Director of Law be and he is hereby authorized <br />and directed to sign on behalf of the City a Judgment Entry dismissing <br />Case No. 78-980017 entitled, Robert A. Novak vs. City of Lakewood, et al, <br />currently pending in the Court of Conn~n Pleas of CuyahogaCounty settling <br />and dismissing said case with prejudice as to all defendants. <br /> <br /> Section 4. That this ordinance is hereby declared to be an <br />emergency measure for .the reasons stated in the preamble hereof and provided. <br />it receives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force iranediately upon its adoption <br />and approval by the Mayor; otherwise it shall take effect and be in force <br />from and after the earliest period allowed by law. <br /> <br />Approved: ~.~'~a..~/~. /z~ <br /> <br /> <br />
