l)] ,I,~,~E SUI.~'qT['IUTF, 1;l)l{ ()~ tJ )i NAN(JJ~i <br />;~IIC]t WAS RI:lv~J~t~;]) TO qRA~7IC SAFETY <br />CX)MMI~ ON NOVE}fl3ER 6, 1978. <br /> <br />ORDINANCE NO. 99-78 <br /> <br />BY: Chinnock, Magnotto, McBride, Salmon, <br /> Wendling, Brockman, Brown <br /> <br /> AN t~IERG~ ORDINANCE to supplement Section 351.21 of the <br />Traffic Code~of the Codified Ordinances of the City of Lakewood by enacting <br />new subparagraph (c) thereof to provide for exemption from the 3:00 a.m. to <br />6: 00 a.m. parking ban and the 8: O0 a.m. to 4: 00 p.m. snow emergency parking <br />ban in effect on certain streets within the City and to provide for a permit <br />therefor to qualifying residents. <br /> <br /> WHEREAS, the Director of Public Safety pursuant to authority of <br />Section 351.21 of the Traffic Code of the Codified Ordinances of the City <br />of Lakewood has established an overnight parking ban on certain streets in <br />the City of Lakewood, and <br /> <br /> WHEREAS, such ban which prohibits parking between the hours of <br />3:00 a.m. to 6:00 a.m. daily, has caused unreasonable hardship to certain <br />residents on the streets affected by such ban, and <br /> <br /> WHERFAS, on October 16, 1978, Cotmcil adopted Ordinance No. 87-72 <br />which, in part, provided for an emergency snow parking ban between the hours <br />of 8:00 a.m. to 4:00 p.m. on certain streets in the City of Lakewood, and <br /> <br /> WHEP~AS, this Council is of the opinion that it is in the best <br />interests of the City to provide some relief from'such parking restrictions <br />to those persons meeting certain qualifications and to provide for the <br />issuance of a permit for the parking on such streets during such prohibited <br />times, and <br /> <br /> WT{FffLEAS, this ordinance constitutes an emergency measure providing <br />for the inmediate preservation of the public safety and welare and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT ORDAIN-ED BY THE CCIJNCIL OF THE CITY OF LAKI~q®, STA2~ OF <br /> <br /> Section 1. That Section 351.21. of the Traffic Code of the <br />Codified Ordinances of the City of Ix~ewood be and the same is hereby <br />supplemented by enacting new subparagraph (c) thereof to read ms follows: <br /> <br />351.21 POWERS OF DIRtL~FIOR OF PUBLIC SAFETY <br /> <br /> (c) The Director of Public Safety is hereby m~thoriZed to <br /> exempt residents on those streets upon which parking is <br /> prohibited between the hours of 3:00 a.m. and 6:00 a.m. <br /> daily, from such prohibition and to exempt residents from <br /> the 8:00 a.m. to 4:00 p.m. snow emergency parking ban <br /> as provided in paragraph (c) of Section 351.26 of this <br /> Code, provided said residents qualify for such exemption <br /> under rules and'regulations, as shall be established by <br /> the Director of Public Safety and approved by Council <br /> relating thereto. Applications for such exenption shall <br /> be filed with the Director of Public Safety who m~v issue <br /> an all night parking permit for any motor vehicle owned by <br /> a qualifying applicant. A fee of ten dollars ($10.00) <br /> shall be charged for each permit issued hereunder. The ~nitial <br /> permit she. l] be valid 'f~.)m the date of iss~(~ up to and including <br /> June 30,1980 and all subs(~uent penni'ts shall be valid for a <br /> two (2) year period. <br /> Section 2. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of ail members elected to Council, it <br />shall take effect and be in force immediately upon its adoption and <br />approval by the Mayor; otherwise it shall take effect and be in force from <br />and after the earliest period allowed by law. <br /> <br /> <br />
