ORDINANCE NO. <br /> <br />4-79 <br /> <br />BY: Brown, Chinnock, McBride, <br /> Salmon, Wendling, Brockman <br /> <br /> AN EMERGENCY ORDINANCE to enact new Chapter 771 of the Business <br /> Regulation Code of the Codified Ordinances of the City of Lakewood relating <br /> to a permit for forestry and tree surgery work and repealing Section 565.16 <br /> of the General Offenses Code of the Codified Ordinances of the City of Lakewood. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br /> for the immediate preservation of the public health, safety and welfare and <br /> for the usual daily operation of a municipal department; now, therefore, <br /> BE IT ORDAINED.BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> OHIO: <br /> <br /> Section 1. That the Business Regulation Code of the Codified <br /> Ordinances of the City of Lakewood be supplemented by enacting new Chapter <br />· 771 relating to forestry and tree surgery work which shall read as follows: <br /> <br /> CHAPTER 771 <br />FORESTRY AND TREE SURGERY <br /> <br />771.O1 PERMIT REQUIREMENT. <br /> <br /> No person, firm or corporation shall solicit for or engage <br />in any kind of forestry or tree surgery work for hire for another <br />person, firm or corporation within the City of Lakewood without <br />first obtaining a forestry and tree surgery permit from the <br />Division of Permits. <br /> <br />771.02 APPLICATION FOR PERMIT. <br /> <br />Applicants for a permit pursuant to this Chapter, shall <br />make application for such permit on a form provided by the super- <br />intendent of the Division of Parks and Public Grounds. The <br />applicant for the permit shall certify thereon that he is pre- <br />pared and agrees to remove any and all tree branches, logs, <br />stumps and other debris resulting from such work from the premises <br />wherein the work was performed to a proper disposal site as <br />determined by the City, within five (5) days from the date of <br />cutting of the branches, logs and stumps and other debris which <br />resulted from the performance of such work. <br /> <br />771.O3 TIME AND FEE <br /> <br /> The permit shall be valid for the calendar year in which <br />issued and shall be Fenewed annually thereafter. A fee of <br />Fifteen Dollars ($15.OO) shall be paid at the time of the <br />original issuance and at each renewal thereafter. <br /> <br />771.O4 INSURANCE. <br /> <br /> Each applicant shall file certificates of insurance or <br /> evidence thereof with the Superintendent of the Division of <br />.Parks and Public Grounds that he is protected under the Workmen's <br /> Compensation Act and that he maintains such insurance as will <br /> protect him from other claims or damages to property or for <br /> personal injury, including death, which may arise from the <br /> operations under such permit, whether such operations are by <br /> the permit holder or any other permit holder who may be a sub- <br /> contractor employed thereby or any one directly or indirectly <br /> <br /> <br />
