ORDINANCE NO. 11-79 <br /> <br />BY: Chinnock, Magnotto, McBride, <br /> Wendling, Brockman, Brown <br /> <br /> AN EMERGENCY ORDINANCE acknowledging receipt of the Lakewood <br />Town Center Phase I Redevelopment Area Report; and authorizing an option <br />to purchase real property located within the boundaries of Phase I the <br />study area of-such Report, determining that such real property will not <br />be needed for public use; determining that such real estate should be <br />sold and that such sale is in the best interest of the City and will <br />further the interests of the City and its residents; and determining <br />that the proposed purchase price is satisfactory. <br /> <br /> WHEREAS, the City has received a report from its project <br />consultants, Henshaw, Hartt & VanPetten, Inc. and the CuyahOga County <br />Regional Planning Commission entitled "Lakewood Town Center" which <br />this Council will review and take such action upon as it deems appro- <br />priate; and <br /> <br /> WHEREAS, the City is. the owner of real property being <br />Permanent Parcel Nos. 314-4-13, 314-4-14 and a portion of 314-4-21 <br />bounded on the' north by 314-4-13, on the south by 314-4-14 on the <br />west by Victoria Avenue and on the east by the extension of the <br />easterly line of 313-4-13 and 313-4-14, located-within the boundaries <br />of Phase I the study area of said Report, which real property should <br />be offered for sale for development purposes by means of 9rantin9 <br />an option to purchase in the best interests of the City and its <br />residents; and <br /> <br /> WttEREAS, said real property is being used for public parking <br />but is to be replaced by equivalent public parking in other City owned <br />real property resulting in said property not being needed for public <br />use by the City; and <br /> <br /> WHEREAS, to insure that any actions determined appropriate <br />by this Council in regard to the Lakewood Town Center Phase I Redevelopment <br />Area Report are not jeopardized by the sale of this property pursuant to <br />the option to purchase, the terms of such sale should not be inconsistent <br />with the provisions of said Report regarding Phase I; and <br /> <br /> WHEREAS, the Mayor has requested granting of an option to purchase <br />for said property to the Community Development Corporation of Lakewood, <br />a non-profit corporation organized pursuant to Chapter 1702 of the Ohio <br />Revised Code (hereinafter sometimes referred to as the 'Developer") <br />subject to the approval o~ the Department of Housing and Urban Development;and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public peace, property, <br />health and safety and for the further reason that the immediate authoriza- <br />tion of the actions herein to expedite the development and revitalization <br />of the City is necessary in order to create and preserve jobs and <br />employment opportunities and to prevent the spread of blighted, de- <br />terior.ated or deteriorating conditions; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT ORDAINED BY TIlE COUNCIL OF TIlE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That this Council hereby finds and determines that <br />the real property described as bein9 Permanent Parcel Nos. 314-4-13 and <br />314-4-14 on the tax maps of the Auditor of Cuyahoga County, Ohio, and a <br />portion of 314-4-21 bounded on the north by 314-4-13, o~ the south by <br /> <br /> <br />
