Section 4. The City of Lakewood has received signed letters of intent, <br />where appropriate, from each significant industrial user, as defined by. Section <br />35.925-12 to pay that portion of the grant amount allocable to treatment of its <br />wastes. Each such letter includes a statement of the industrial user's intended <br />period of use of the treatment works. The City of Lakewood agrees to require <br />all industrial users to pay that portion of the grant amount allocable to treat- <br />ment of waste from such users. <br /> <br /> Section 5. The City of Lakewood has enacted, and will continue to enforce <br />throughout its jurisdiction, a sewer use ordinance prohibiting any new down- <br />spout connections into the sanitary sewer portions of the treatment system and <br />ensuring that new sewers and connections to the sewer system are properly <br />designed and constructed,as provided in Section 35.927-4. <br /> <br /> Section 6. The Mayor, ex-officio Director of Public Works, be and he <br />hereby is authorized to submit and sign all forms and agreements now or here- <br />after required for signature or agreement with the Ohio and United States <br />Environmental Protection Agencies for applications for grants related to <br />construction of sewage treatment works. <br /> <br /> Section 7. The City has reviewed the facilities plan entitled Facility <br />Plan, City of Lakewood, Wastewater Collection and Treatment Facilities, and <br />hereby accepts the recommendations of the plan as displayed on Figures 9.1 and <br />9.2. The City hereby agrees to implement the recommendations of bhe plan by <br />authorizing negotiation of engineering agreements and further agrees that said <br />implementation shall be consistent with the provisions of the NPDES permit <br />compliance schedule. <br /> <br /> Section 8. That Ordinance No. 59-78, adopted July 5, 1978 is hereby re- <br />pealed. <br /> <br /> Section 9. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members, elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise at the earliest period provided by law. <br /> <br /> <br />
