-4- <br /> <br />(k) Demolition. <br /> <br /> Upon enactment of said resolution by City Council, service of <br />said resolution shall be given in accordance with Section 1305.521(d), <br />and if the owner or person in control of the structure fails, neglects <br />or refuses within forty-five (45) days of said service to comply with <br />the decision and order of the Board, as confirmed by City Council, <br />the City acting through the. B6ilding Commissioner shall cause said <br />structure to be repaired or demolished in accordance with the decision <br />and order of the Board as confirmed by City Council. <br /> <br />(1) Right of Appeal. <br /> <br /> Notwithstanding any provisions contained herein, the owner or <br />person in control of the structure shall have the right to appeal <br />the decision and order of the BoaFd as confirmed by City Council to <br />a court of competent jurisdiction. <br /> <br /> (m) Expenses and Costs of Repair or Demolition. <br /> <br /> Any expense or cost incurred by the City for repair or demolition <br />under the provisions of this Housing Code shall be paid by the owner <br />of the structure or premises. If expenses and costs of repair or <br />demolition are not paid by the owner or person in control thereof'of <br />the structure or premises within thirty (30) days after receipt of <br />written notice from the City sent by registered or certified mail, <br />return receipt requested, or-if his whereabouts are unknown and <br />cannot with reasonable diligence be obtained after such notice is <br />published once in a newspaper of general circulation within the City, <br />the costs of such repair or demolition may be recovered by an action <br />at law against the owner, or may, by action of Council by resolution <br />certified to the County Auditor, be added to the tax.duplicate as an <br />assessment against the land of the owner upon which the structure <br />stands or did stand and shall become a lien thereof, and shali be <br />collected in the manner provided by law for assessments. <br /> <br /> Section 2. This ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives the affirmative <br />vote of two-thirds of all members elected to council, and shall take effect and be <br />in force immediately upon its adoption and approval by the Mayor; otherwise it shall <br />take effect and be in force from and after the-earliest period allowed by law. <br /> <br />Adopted <br /> <br />Approved <br /> <br /> <br />
