ORDINANCE NO. 35-79 <br /> <br />BY: Chinnock, Magnotto, McBride, <br /> Salmon, Wendling, Brockman <br /> Brown <br /> <br /> AN EMERGENCY ORDINANCE to amend Division D of Chapter 3 of the <br />Regional Building Code of the Codified Ordinances of the City of Lakewood <br />relating to unsafe structures. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Division D of the Regional Building Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />1603.50 General <br /> <br /> All buildings or structures which are structurally unsafe, <br />unsanitary, or not provided with adequate safe egress, or which <br />constitute a fire hazard, or are otherwise dangerous to human <br />life, or which in relation to existing use constitute a hazard <br />to safety or health by reason of inadequate maintenance, dilapida- <br />tion, obsolescence, or abandonment are, for the purposes of this <br />Division, declared to be unsafe structures. All such unsafe <br />structures are hereby declared to be public nuisances and shall <br />be abated by repair, rehabilitation, demolition or removal in <br />accordance with the procedures specified in Sections 1603.51 <br />through 1603.56. <br /> <br />1603.51 Notice to Owner <br /> <br /> The Building Official shall examine or cause to be examined <br />every building or structure or portion thereof reported as dangerous <br />or damaged and, if such is found to be an unsafe building as de- <br />fined in this Division, the Building Official shall give to the <br />owner of such building or structure written notice stating the <br />defects thereof. This notice shall require the owner within a <br />stated time either to complete specified repairs or improvements <br />or to demolish and remove the building or structure or portion <br />thereof. <br /> <br />1603.52 Serving of Notice <br /> <br /> Proper service of such notice shall be by personal service <br />upon the owner of r~cord, if he shall be found within the city <br />limits. If he is not found within the city limits, such service <br />may be made upon said owner by registered mail; provided, that if <br />such notice is by registered mail, a designated period within <br />which said owner or person in charge is required to comply with <br />the order of the Building Official shall begin as of the date'of <br />receipt of such notice. <br /> <br />]603.53 Posting of Signs <br /> <br /> The Building Official shall cause to be posted at e~ch' <br />entrance of such building a notice to read: "DO NOT ENTER. <br />UNSAFE TO OCCUPY. Building Department." Such notice shall <br />remain posted until the required repairs, demolition, or re- <br />moval are completed. Such notice shall not be removed without <br />written permission of the Building Official and no person shall <br />enter the building except for the purpose of making the required <br />repairs or demolishing the building. <br /> <br /> <br />
