ORDINANCE NO. 35-79 BY: Chinnock, Magnotto, McBride, Salmon, Wendling, Brockman Brown AN EMERGENCY ORDINANCE to amend Division D of Chapter 3 of the Regional Building Code of the Codified Ordinances of the City of Lakewood relating to unsafe structures. WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Division D of the Regional Building Code of the Codified Ordinances of the City of Lakewood now reading as follows: 1603.50 General All buildings or structures which are structurally unsafe, unsanitary, or not provided with adequate safe egress, or which constitute a fire hazard, or are otherwise dangerous to human life, or which in relation to existing use constitute a hazard to safety or health by reason of inadequate maintenance, dilapida- tion, obsolescence, or abandonment are, for the purposes of this Division, declared to be unsafe structures. All such unsafe structures are hereby declared to be public nuisances and shall be abated by repair, rehabilitation, demolition or removal in accordance with the procedures specified in Sections 1603.51 through 1603.56. 1603.51 Notice to Owner The Building Official shall examine or cause to be examined every building or structure or portion thereof reported as dangerous or damaged and, if such is found to be an unsafe building as de- fined in this Division, the Building Official shall give to the owner of such building or structure written notice stating the defects thereof. This notice shall require the owner within a stated time either to complete specified repairs or improvements or to demolish and remove the building or structure or portion thereof. 1603.52 Serving of Notice Proper service of such notice shall be by personal service upon the owner of r~cord, if he shall be found within the city limits. If he is not found within the city limits, such service may be made upon said owner by registered mail; provided, that if such notice is by registered mail, a designated period within which said owner or person in charge is required to comply with the order of the Building Official shall begin as of the date'of receipt of such notice. ]603.53 Posting of Signs The Building Official shall cause to be posted at e~ch' entrance of such building a notice to read: "DO NOT ENTER. UNSAFE TO OCCUPY. Building Department." Such notice shall remain posted until the required repairs, demolition, or re- moval are completed. Such notice shall not be removed without written permission of the Building Official and no person shall enter the building except for the purpose of making the required repairs or demolishing the building.
