-2- <br /> <br />1603.54 Disregard of Notice <br /> <br /> In case the owner, agent, or person in control cannot be <br />found within the stated time limit, or if such owner, agent or <br />person in control shall fail, neglect, or refuse to comply with <br />the notice to repair, rehabilitate, or to demolish and remove <br />said building or structure or portions thereof, the Director of <br />Law shall be advised of all the facts in the case, and shall <br />institute an appropriate action in the courts to compel a com- <br />pliance. <br /> <br />1603.55 Cases of Emergency <br /> <br /> In cases of emergency which, in the opinion of the Building <br />Official, involve immediate danger to human life or health, said <br />Building Official shall promptly cause such building, structure, <br />or portions thereof to be made safe or to be removed. For this <br />purpose he may at once enter such structure or land on which it <br />stands, or abutting land or structure, with such assistance at <br />such cost as he may deem necessary. He may order adjacent <br />structures and premises to be vacated, and protect the public <br />by an appropriate fence or such other means as may be necessary, <br />and for this purpose may close a public or private way. <br /> <br />1603.56 Costs <br /> <br /> Costs incurred under Sections 1603.54 and 1603.55 shall be <br />paid out of the Municipal treasury and the Director of Law shall <br />institute an appropriate action in the courts to recover such <br />costs from the owner of the premises. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />DIVISION D <br />UNSAFE STRUCTURES <br /> <br />1603.50 General <br /> <br /> All buildings or structures and appurtenant structures which <br />are a menace to the public health, safety or welfare or which are <br />structurally unsafe, unsanitary, or not provided with adequate <br />safe egress, or which constitute a fire hazard or are otherwise <br />dangerous to human life, or which in relation to existing use <br />constitute a hazard go the public health, safety, or welfare by <br />reason of inadequate maintenance, dilapidation, obsolescence, <br />or abandonment are, severally, for the purposes of this section, <br />declared to be unsafe structures or public nuisances. All <br />such unsafe structures or public nuisances are hereby declared <br />to be illegal and shall be abated by repair and rehabilitation' <br />or by demolition in accordance with the procedures of this segtion. <br /> <br />1603.51 Notice of Nuisance and Order to Repair or Demolish <br /> <br /> a) Whenever the Building Commissioner determines any <br />building or structure or appurtenant structure to be an unsafe <br />structure or public nuisance as defined in Section 1603.50, he <br />shall give written notice of the order to repair or demolish to <br />the owner or person in control thereof. <br /> <br /> b) Said written notice of nuisance and order to re- <br />pair or demolish shall specify the structure deemed to be <br />an unsafe structure or public nuisance, shall specify which <br />section or sections of this Code are bein9 violated, shall <br /> nclude an order to repair defects therein to allow the <br /> <br /> <br />
