-2- <br /> <br />$5.50 per foot and the benefited footage of lots on Belle Avenue and Waterbury <br />Avenue shall be assessed at the rate of~$3.00 per foot for this improvement, to <br />wit: <br /> <br />All lots and lands bounding and abutting upon the proposed improvement between <br />the termini aforesaid, which said lots and lands are hereby determined to be <br />specially benefited by said improvement; and the cost of said improvement shall <br />include the cost of preliminary and other surveys, plans, specifications, profiles <br />and estimates and of printing, serving and publishing notices, resolutions and <br />ordinances, the amount of damages resulting from the improvement assessed in <br />favor of any owner of land affected by the improvement and the interest thereon, <br />the costs incurred in connection with the preparation, levy and collection of the <br />special assessments, the cost of purchasing, appropriating, and otherwise acquiring <br />therefor any required real estate or interests therein, expenses of legal services <br />including obtaining and approving legal opinion, cost of labor and material and <br />interest on bonds and notes issued in anticipation of the levy and collection of <br />the special assessments together with all other necessary expenditures. <br /> <br /> Section 5. That the list of estimated assessments as heretofore prepared <br />by the Director of Finance and included in the report of the Board of Revision <br />of Assessments be and the same is hereby approved and the assessments so to be <br />levied shall be paid in ten (10) semi-annual installments, with interest on <br />deferred payments at the same rate as shall be borne by the bonds to be issued <br />in anticipation of the collection thereof, provided that the owner of any <br />property to be assessed may, at his option, pay such assessment in cash within <br />thirty (30) days after the passage of the assessing ordinance. <br /> <br /> Section 6. That obligations of the City shall be issued, in anticipation <br />of the collection of special assessments by installments and in an amount <br />thereto, for the purpose of providing funds to pay the cost of this improve- <br />ment. <br /> <br /> Section 7. That the remainder of the entire cost of this improvement, <br />after application of the assessments herein provided shall be paid by the issuance <br />of notes and bonds of the City in the manner provided by law. <br /> <br /> Section 8. That pursuant to Article XIV, Section 16, of the Charter of <br />the City, the Director of Public Works has heretofore certified to this Council <br />this his estimate of the life of the imporvement described in Sections I and 2 <br />hereof is ten (10) years. <br /> <br /> Section 9. That the Clerk of Council be and she is hereby directed <br />to deliver the Auditor of Cuyahoga County a certified copy of this ordinance <br />within fifteen (15) days following its passage. <br /> <br /> Section 10. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting ~f this Council, and that all deliberations of this <br />Council and of any of its Committees that resulted in such formal action, were <br />in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 1. That this ordinance, having been declared to be.an <br />emergency measure, for the reasons stated in the preamble hereof and provided it <br />receives the affirmative vote of two thirds of all members elected ts Council, <br />it shall take effect and be in force immediately upon its adoption and approval <br />by the Mayor; otherwise it shall take effect and be in force from and after <br />the earliest p~eriod allowed by law. ~ - - <br />Adopted: ~/ //~ x~ ~--'~ <br />Approved: .~.~ '~ ~x/~x~ ~~~ j ~x - ~ Mayor ~ <br /> <br /> <br />
