<br />PLeA, <br />COpy <br /> <br />:)STITUTE FOH <br />/,'1 ,~IT:, OOCKET <br /> <br />FO <br /> <br />OHOINANCE NO, <br /> <br />42-79 <br /> <br />BY: Brockman, Brown, Chinnock, <br />McNally, Salmon, Wendling <br /> <br />AN eMEHGeNCY ORDINANCE to enact new Chapter 1327 of the Housing Code <br />of thè Codified Ordinances of the City of Lakewood .relating to Condominiums and <br />repealing all other ordinances or parts of ordinances inconsistent therewith. <br /> <br />WHEReAS, the City of Lakewood is a home rule municipality, and by <br />authority of the Constitution of Ohio, it has authority to regulate the use of <br />buildings for the protection of the public health, safety and welfare, and <br /> <br />WHEREAS, the condominium form of property Dwnership has become in- <br />creasingly popular in the City of Lakewood in recent years, and <br /> <br />WHEREAS, growth in the use of the condominium form of property ownership <br />has significant impact on the general welfare and well-being of the citizens of the City <br />of Lakewood, and <br /> <br />WHEREAS, prospective purchasers of condominium units have often been <br />unable to obtain full disclosure of all information necessary to make the <br />decision whether to purchase, and <br /> <br />WHEREAS, standards for the regulation of the sale and operation of <br />condominiums are necessary for the protection and welfare of the citizens of the <br />City of Lakewood, and <br /> <br />WHEREAS, this Chapter constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety anp welfare of the citizens <br />of the City of Lakewood, and for the further reason that s:uch standards should be <br />established at the earliest possible timej now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO, <br /> <br />Section I. That the Buildinq Code of the Codified Ordinances of the <br />City of Lakewood be supplemented by enactinq now Chapter 1327 relating to <br />Condominiums which shall read as follows: <br /> <br />CHAPTeR 1327 <br />CONDOMINIUMS <br /> <br />1327.01 TITLE AND PURPOSE. <br />(a) Title. <br /> <br />This ordinance shall be known and may be cited as thè <br />IILakewood Residential Condominium Ordinance". <br /> <br />(b) Purpose, <br /> <br />It is the purpose of this ordinance and the policy of the <br />City of Lakewood to establish standards for all future <br />conversion condominium developments within the City in order <br />to protect the tenants of rental ,units designated for condo- <br />minium conversion and the purchasers of conversion condominium <br />units and also to encourage the maintenance and imp-rovement of <br />the housing in the City of Lakewood. <br /> <br />1327.02 CONSTRUCTION; SEVERABILITY; APPLICABILITY. <br /> <br />(a) Construction. <br /> <br />This ordinance shall be liûerally construed and applied to <br />promote its purposes and policies. <br /> <br />(b) Severability, <br /> <br />If any provision of this ordinance or the application thereof <br />to any person or circumstance is held invalid or uncons~itu- <br />tional by any court Df competent jurisdiction, such provision <br />shall be aeemed a separate, distinct and independent provision, <br />and neither the remainder of this ordinance nor the application <br />- of such provision to other persons or circumstances shall be <br />affected thereby. <br />
