<br />-14- <br /> <br />(3) To engage in any transaction, practice, or course <br />of business which operates or would operate as a <br />fraud or deceit upon a purchaser; or <br /> <br />(4) To make or cause to be made in any document required <br />by this ordinance any statement or representation <br />that is knowingly false or misleading; or <br /> <br />(5) To makè or cause to be made to any purchaser any <br />oral representation which differs from the statements <br />made in any document required by this ordinance. <br /> <br />(b) Specific Unlawful Representations. <br /> <br />It shall be unlawful for any developer or agent in selling <br />or offering to sell any condominium unit in any condominium <br />development" <br /> <br />(1) To request a tenant and/or purchaser to acknowledge <br />receipt of any notice or public offering statement <br />which he has not received, or to falsify the date of <br />recei pt; or <br /> <br />(2) To certify falsely to having provided notices of the <br />puòlic offering statement required by this ordinance; <br />or <br /> <br />(3) To employ undue pressure to induce a tenant to purchase <br />a unit which intrudes on or prevents his use of his <br />best judgment in deciding whether to purchase, including <br />the fo 11 owi ng: <br /> <br />(A) Any direct or indirect increase or decrease in <br />the purchase price or benefits offered to tenants <br />during any portion of the period during which <br />the tenants are entitled to a right of first <br />refusal pursuant to Section 1327.06(h). <br /> <br />(S) Any false statements as to the number of standby <br />or backup sales contracts or reservations or <br />subscriptions or like agreements. <br /> <br />(c) Any false statement prior to the end <br />of the period during which the tenant may not <br />be evicted without cause pursuant to Section <br />1327.06 as to a future rent increase. <br /> <br />(D) Any false statement relating to future conversions <br />which would reduce rental 'units available in the <br />City, <br /> <br />132708 EQUAL OPPDRTUNITY. <br /> <br />No person. shall be denied the right to purchase or lease a condominium <br />unit in the City of Lakewood because of race, color,creed, sex, <br />religious beliefs or national origin. <br /> <br />1327 .og REMeDIES. <br /> <br />(a) Public's Remedies. <br /> <br />(1) The rights, obligations and remedies set forth in this <br />ordinance shall be cumulative and in addition to any <br />üthers available at law or in equity. <br /> <br />(2) The City or any tenant or purchaser or owner of a unit <br />may seek compliance of any provision of this ordinance in <br />a court of competent jurisdiction, provided, however, <br />that only the City may enforce the provisions of Section <br />13U.09(b). <br />
