. -4- If for any reason, through Federal regulation or otherwise and for reasons within or beyond the control of the Company, said Company shall cease to furnish its services to its subscribers, the original installation fee shall be refunded, at a pro-rata basis, to all subscribers who have had the benefit of said service for less than one {1) year, each Such sbUscriber to receive a refund of one-twelfth of ~aid installation fee for each month, or portion thereof, in which the subscriber is not furnished said service by the Company. The Company shall have the right to make all rules and · regulations giverning its services providing same are uni'form and not inconsistent with the terms hereof. shall be and the same is hereby amended to read as follows: Section 9. By its acceptance of the' Franchise, the Grantee agrees that the City Council shall have the power, authority,' and right to cause the Grantee's rates and charges to conform to provisions hereof and for this purpose, the Council may deny increases or order reductions or such rates and charges when it determines that in the absence of such action on its part the Grantee's rates and charges or proposed rates and charges will not conform to the provisions contained herein. The rates and charges for television signals distributed hereinunder shall be fair, reasonable and non-discriminatory. The Grantee shall be allowed to increase its rates only if it can demonstrate to the Council's satisfaction that it cannot make a fair return on its investment without, a rate increase. : The Company agrees, however, to provide free installation to all government buildings and public institutions and to all schools both public and parochial, upon written request of said institutions and schools. All fees and. charges are exclusive of any tax or taxes whatsoever assessed or assessable against the scheduled installations and/or services. The scheduled attachment fees shall include that material and labor necessary to make a normal-type connection from the Company's lines to the subscriber's receiver. ia) Charge for initial attachment for single outlet shall be at the maximum rate of $15.00 each. Charge for extensions from initial attachment shall be at the maximum rate of $5.00 each. Extensions shall be limited to the commercial structure and/or dwelling residenEe unit to be serviced by the initial' attachment. {b) Charge fo~ transmission to'single set re~;iving signals initial attachment shall be at the maximum rate of $5.90 per month. (c) Charge for transmission to each set'receiving signals on extension or extensions from initial attachment shall be at the rate of $1.00 set per month. id} A deposit not to exceed $10.00 and a rental charge not to exceed $1.00 monthly for a multi,channel set top converter.
