OPJ)IN~tNC}~ NO. 8-80 B~f: Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendling, Brown <br /> AN EMERGENCY ORDINANCE giving consent to the Director of TransPortation <br />of the State of Ohio to inprove the grade crossing warning system at the grade <br />crossing of Warren Road and the railroad tracks of the Norfolk and Western Railway <br />Company in the City of Lakewcod. <br /> <br /> WHEI~AS, the Director of Transportation of the State of Ohio proposes <br />the improvement of the passive signing, in conformance with the Ohio Manual of <br />Uniform Traffic Control Devices, at the following railroad-highway grade crossing, <br />by the medernization of the existing flashing light signals and the addition of <br />roadway gates at the grade crossing of Warren Road and the tracks of the Norfolk <br />and Western Railway Company, and <br /> <br /> WHEREAS, the ll0th General Assembly of the State of Ohio has passed <br />Amended House Bill No. 111 which provides funds for the construction of the <br />improvement of the grade crossing warning system as conten~olated herein, and <br /> <br /> WHEREAS, this ordinance is hereby declared to be an emergency measure <br />by reason of the need for expediting the planning and construction of the aforesaid <br />ir~provement~ and upon its acceptance and approval by the Director of Transportation <br />it shall become a binding agreement on the City and the Director; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LABiEWOOD, STATE OF OHIO: <br /> <br /> Section 1. It is declared to be in the public interest that the consent <br />of the City be and such consent is hereby given to the Director of Transportation <br />of the State of Ohio to proceed with the improvement of the passive signing, in <br />conformance with the Ohio ~anual of Unifo~n Traffic Control Devices, at the <br />following railroad-highway grade crossing, by the modernization of the existing <br />flashing light signals and the addition of roadway gates at the grade crossing <br />of Warren Road and the tracks of the Norfolk and Western Railway Company. in <br />accerdance with the plans, specifications and estimates as approved by the Direc~Qr,... <br />at no cost to the City. <br /> <br /> Section 2. The City agrees to perpetuate and maintain all ref~ect~rized <br /> advance warning signs and. perpetuate and maintain ail pavement markings on the <br />approaches to the at-grade crossing inside the City installed and placed herein <br /> cenforraing to the Ohio Manual of Unifo~n Traffic Control Devices in compliance <br /> with the provisions of Section 4511.11 and related sections of the Ohio Revised Code. <br /> <br /> Section 3. That the Clerk of Council be and she is hereby authorized <br />and directed to forward a certified copy of this ordinance to the Director of <br />Transportation of the State of Ohio upon its adoption. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons Stated in t.he preamble hereof and provided it receives <br />the affirmative vote of two-thirds of ail members elected to Council it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect at the earliest per~r.i~d allowed by law. _ , <br /> <br />Accepted and approved: <br /> <br />Attest: <br /> <br />Director, Ohio Department of <br /> Transportation <br /> <br /> <br />
