ORDINANCE NO. ]7-80 <br /> <br />BY: Gallagher, Graham, McBride, <br /> Wendling, Brown, Chinnock <br /> <br /> AN EMERGENCY ORDINANCE approving a Collective Bargaining Agreement <br />with the Western Cuyahoga Fraternal Order of Police Lodge Number 25 - Lakewood <br />Division, establishing conditions of employment, working conditions and <br />various benefits for certain employees of the Division of Police of the City <br />of Lakewood, authorizing the Mayor and the Director of Finance to sign said <br />Agreement on behalf of the City and ratifying their signatures affixed thereto. <br /> <br /> WHEREAS, a prior Collective Bargaining Agreement entered 'into <br />between the City of Lakewood and the Western Cuyahoga Fraternal Order of <br />Police Lodge Number 25 - Lakewood Division, terminated on December 31, 1979, <br />and <br /> <br /> WHEI{EAS, discussions and negotiations have been conducted on behalf <br />of the City with representatives of the said Western Cuyahoga Fraternal Order <br />of Police Lodge Number 25 - Lakewood Divisions with respect to conditions of <br />employment, working conditions and various kenefits for certain employees of <br />the Division of Police of the City of Lakewood, and <br /> <br /> WHEREAS, an agreement has been reached in the course of said <br />discussions and negotations with respect to the conditions of employment, working <br />conditions and various benefits for the certain employees aforementioned, and <br /> <br /> WHEREAS, this Council determines that it is in the best interest of <br />the City to approve said Collective Bargaining Agreement and to authorize the <br />Mayor and Director of Finance to sign same on behalf of the City and to ratify <br />their signatures affixed thereto, and <br /> <br /> WHEltEAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare~an~for <br />the usual daily operation of a municipal department, and for the further reason <br />that it is necessary for the approval of said Agreement at the earliest possible <br />time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br />OHIO: <br /> <br /> Section 1. That the Collective Bargaining Agreement with the <br />Western Cuyahoga Fraternal Order of Police Lodge Number 25 - Lakewood Division <br />dated February 29, 1980 and effective for the period January 1, 1980 to <br />December 31, 1981, an original copy of which is on file in the office of the <br />Mayor of the City of Lakewood and is made a part hereof as though written <br />fully herein, is hereby adopted, ratified and approved and the Mayor and the <br />Director of Finance are hereby authorized and directed for and on behalf of the <br />City to affix their signatures thereto and their signatures affixed thereto <br />are hereby ratified. <br /> <br /> Section 2. That all other ordinances or resultions, or parts of <br />ordinances of resolutions w~ich are inconsistent with this ordinance and the <br />Collective Bargaining Agreement made a part hereof are hereby repealed as of <br />January 1, 1980 to the extent that they pertain to employees in the bargaining <br />unit covered by the Collective Bargaining Agreement and are inconsistent with <br />this ordinance including the Collective Bargaining Agreement attached hereto <br />and made a part hereof. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise it shall take effect and be in force from and after the earliest <br /> <br />period allowed by law. <br /> <br />Adopted: <br /> <br />ApP roved: ~~/ <br /> <br />Mayor <br /> <br /> <br />
