ORDINANCE NO. 21-80 <br /> <br />BY:Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> Brown <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 905.02 of the Streets and <br />Public Services Code of the Codified Ordinances of the City of Lakewood to make <br />it unlawful to enter into or remain in City parks during certain hoars. <br /> <br /> WHEREAS, there has been an increase ~n the vandalism in our City <br />parks, and <br /> <br /> WHEREAS, in the parks which are unlighted a problem exists in the <br />growing number of complaints of incidents of congregating of unsupervised <br />youths, and <br /> <br /> WHEREAS, this Council is of the opinion that the problems in such <br />parks can be el iminted by limiting access to the unlighted parks to daylight <br />hours, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br />OHIO: <br /> <br /> Section 1. That Section 905.02 of the Streets and Public Services <br />Code of the Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />905.02 HOURS OPEN TO PUBLIC. <br /> <br /> Parks shall be open daily for use by the general public; <br />provided however, no person other than an on-duty employee of the <br />City shall enter into or remain wTthin the limits of the City. parks <br />between the hours of ll.'O0 p.m. and 7:00 a.m. (Ord. 51-74. Passed <br />6-3-74.) <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />905.02 HOURS OPEN TO PUBLIC. <br /> <br />(a) Parks shall be open daily for use by the general public. <br /> <br /> (b) No person other than an on-duty employee of the City <br />shall enter into or remain within the limits of Lakewood Park, <br />Madison Park or Kaufman Park between the hours of 11:00 p.m. and <br />sunrise. <br /> <br /> (c) No person other than an on-duty employee of the City <br />shall enter into or remain within the limits of Webb Park, Wagar <br />Park, Edwards Park or Cove Park during the time from one hour <br />after sunset to sunrise. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its adoption and approval <br />by the Mayor; otherwise it shall take effect at the earliest period provided <br />by law, and existing ection 905.02 of the Street and Public Services Code, <br /> <br />adopted June 3, 1974 shall be and the same <br />Adopted: <br /> <br />Approved: ~ <br /> <br />y~~~r e pea 1 e d.4 ~ <br /> <br /> <br />
