ORDINANCE NO. 26-80 <br /> <br />BY:Brown, Chinnock, Galla§her, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor on behalf <br />of the City of Lakewood to make application for Federal-aid Urban "Mu Funds and <br />granting the consent to the Director of the Department of Transportation to <br />construct improvements hereinafter described under the supervision of the <br />Director of Transportation subject to final approval of the City of Lakewood. <br /> <br /> WHEREAS, the public interest and safety demands the improvements of <br />portions of the following described public highways, said improvement to include <br />the installation and improvement of traffic signals, signs and pavement markings <br />at major intersections on various routes within the City of Lakewood. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety and welfare, and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That it is declared to be in the public interest that the <br />consent of said City be and such consent is hereby given to the Director of <br />Transportation to construct the above-described improvement, in accordance with <br />plans, specifications and estimates as approved by the City of Lakewood and by <br />the Director <br /> <br /> Section 2. That said City hereby proposes to cooperate with the <br />of Ohio, in the cost of the above-described improvement as foltows: <br /> <br />Assume and contribute upon approval by the City of Lakewood the <br />entire cost and expense of the improvement less the amount of <br />Federal-aid Urban"M" Funds set aside by. the Director of <br />Transportation and the Northeast Ohio Areawide Coordinating <br />Agency (NOACA) for the financing of this improvement from funds <br />allocated by the Federal Highway Administration, U.S. Department <br />of Transportation. Further, the City agrees to assume and bear <br />one hundred percent (100%) of the cost of preliminary engineering <br />and right-of-way. <br /> <br /> Section 3. That the Mayor of said City is hereby empowered and directed <br />on behalf of the City to enter into agreements with the Director of Transportation <br />necessary to complete the planning and construction of this improvement subject to <br />the approval of Council. <br /> Section 4. That upon completion of said improvement, said City will <br />thereafter keep said highway open to traffic at all times, and <br /> <br />(a) <br /> <br />Maintain the improvement in accordance with the provisions of <br />the statutes relating thereto and make ample financial and <br />other provisions for such maintenance; and <br /> <br />(b) <br /> <br />Maintain the right-of-way and keep it free of obstructions <br />in a manner satisfactory to the State of Ohio and hold said <br />right-of-way inviolate for public highway purposes and permit <br />no signs, posters, billboards, roadside stands or other <br />private installations within the right-of-way limits; and <br /> <br />(c) <br /> <br />Place end maintain all traffic control devices conforming <br />to the Ohio Manual of Uniform Traffic Control Devices on <br />the improvement in compliance with the provisions of Section <br />4511.11 and related sections of the Ohio Revised Code. <br /> <br />(d) Regulate parking in the following manner: <br /> <br />Prohibit all parking within the limits of intersection improvements. <br /> <br /> <br />
